AN ACT TO AMEND SECTIONS 15-3-340 AND 15-67-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ACTIONS FOR RECOVERY OF REAL PROPERTY, SO AS TO LIMIT THE NUMBER OF ACTIONS THAT MAY BE BROUGHT, AND PROVIDE FOR AN EFFECTIVE DATE OF ONE HUNDRED EIGHTY DAYS AFTER APPROVAL BY THE GOVERNOR.

Be it enacted by the General Assembly of the State of South Carolina:

One action for recovery of real property permitted

SECTION 1. Section 15-3-340 of the 1976 Code is amended to read:

"Section 15-3-340. No action for the recovery of real property or for the recovery of the possession of real property may be maintained unless it appears that the plaintiff, his ancestor, predecessor, or grantor, was seized or possessed of the premises in question within ten years before the commencement of the action."

One action for recovery of real property permitted

SECTION 2. Section 15-67-20 of the 1976 Code is amended to read:

"Section 15-67-20. The plaintiff in actions for recovery of real property or the recovery of the possession of real property is limited to one action for recovery."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
