AN ACT TO AMEND SECTION 12-57-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE FEDERAL TAX LIEN REGISTRATION ACT, SO AS TO CORRECT A REFERENCE, AND TO AMEND THE 1976 CODE BY ADDING SECTION 12-57-55, SO AS TO PROVIDE THAT NOTICES OF LIENS ARISING UNDER THE FEDERAL COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY ACT OF 1980 MUST BE FILED IN THE MANNER THAT FEDERAL TAX LIEN NOTICES ARE FILED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 12-57-20 of the 1976 Code is amended to read:

"Section 12-57-20. This chapter is passed for the purpose of authorizing the filing of notices of lien in accordance with the provisions of Subchapter C, Chapter 64 of Subtitle F of the Internal Revenue Code of 1986, including its predecessors and as it may be amended."

SECTION 2. Chapter 57 of Title 12 of the 1976 Code is amended by adding:

"Section 12-57-55. Notice of liens and certificates of discharge arising from the operation of the Comprehensive Environmental Response, Compensation, Liability Act of 1980, as amended (42 U.S.C. Section 9601 et seq.) must be filed in the manner provided in this chapter for federal tax liens, mutatis mutandis."

SECTION 3. This act takes effect July 1, 1988.
