AN ACT TO PROVIDE THAT ALL MONITORING, OBSERVATION, RESEARCH, OR OTHER TESTING OF WELLS LOCATED IN THE SIX MILE CREEK DRAINAGE BASIN IN LANCASTER AND YORK COUNTIES MUST BE FIRST APPROVED BY THE SOUTH CAROLINA WATER RESOURCES COMMISSION AND TO PROVIDE CERTAIN EXCEPTIONS RELATING TO THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL.

Be it enacted by the General Assembly of the State of South Carolina:

Approval of wells and well monitoring, observation, and research

SECTION 1. All monitoring, observation, research, or other testing of wells located in the Six Mile Creek Drainage Basin in Lancaster and York Counties must be first approved by the South Carolina Water Resources Commission.

The commission is authorized to promulgate regulations necessary to implement the provisions of this section including what constitutes the Six Mile Creek Drainage Basin.

The Department of Health and Environmental Control is authorized to install wells in the Six Mile Creek Drainage Basin without first obtaining the approval of the Water Resources Commission.

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
