AN ACT TO AMEND SECTION 61-3-420, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS INELIGIBLE FOR A RETAIL LIQUOR LICENSE, SO AS TO PROVIDE THAT A PERSON IS INELIGIBLE FOR A LICENSE IF HE IS NOT A RESIDENT INSTEAD OF A CITIZEN OF THIS STATE AND DELETE THE PROVISIONS REGARDING RESIDENCY AND MAINTENANCE OF A PRINCIPAL PLACE OF ABODE IN THE COUNTY IN WHICH THE PROPOSED BUSINESS IS TO BE LOCATED AND OPERATED.

Be it enacted by the General Assembly of the State of South Carolina:

Eligibility for retail liquor license

SECTION 1. Section 61-3-420 of the 1976 Code is amended to read:

"Section 61-3-420. No person is eligible for a license under the provisions of this chapter, Chapter 7, and Article 3 of Chapter 13 if he or the person who will have actual control and management of the business proposed to be operated:

(1) is a minor;

(2) is not a resident of the State of South Carolina;

(3) is not of good repute; or

(4) has had a license under the provisions of this or any previous statute regulating the manufacture or sale of alcoholic liquors which has been revoked within the period of five years next preceding the filing of the applications; unless the Alcoholic Beverage Control Commission in its discretion otherwise orders."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
