A JOINT RESOLUTION TO PROVIDE THAT APPROPRIATIONS IN SECTION 4 OF PART I OF ACT 540 OF 1986, THE GENERAL APPROPRIATIONS ACT, FOR COMMITMENTS, ADMISSIONS, AND DISCHARGES TO MENTAL HEALTH FACILITIES ALSO MAY BE EXPENDED UNDER THE PROVISIONS OF CHAPTER 52 OF TITLE 44 OF THE 1976 CODE, ALCOHOL AND DRUG ABUSE COMMITMENT.
Whereas, the General Assembly created the Involuntary Commitment Act for Alcohol and Drug Abuse; and
Whereas, Section 4 of Part I of Act 540 of 1986, the 1986-87 General Appropriations Act, provides for an appropriation relating to commitments, admissions, and discharges to mental health facilities to be expended for compensation of court appointed private examiners, guardians ad litem, and attorneys for proposed patients, and related court costs arising from the filing, service, and copying of legal papers and the transcription of hearings and testimony; and
Whereas, alcohol and drug abuse commitments were previously treated as mental health commitments. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Authorization for alcohol and drug abuse commitment to be funded through appropriations for mental health facilities for 1986-87
SECTION 1. The General Assembly directs the fund appropriated under Section 4 of Part I of Act 540 of 1986, 1986-87 General Appropriations
Act, for commitments, admissions, and discharges to mental health facilities also may be expended under the provisions of Chapter 52 of Title 44 of the 1976 Code.
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
