AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-1-130 SO AS TO PROVIDE THAT ANY MEMBER OF A FIRE DEPARTMENT, COUNTY VETERANS AFFAIRS OFFICER, CONSTABLE, OR MUNICIPAL JUDGE SERVING AS ATTORNEY FOR ANOTHER CITY IS NOT CONSIDERED TO BE A DUAL OFFICEHOLDER, BY VIRTUE OF SERVING IN THAT CAPACITY, FOR THE PURPOSES OF THE CONSTITUTION.

Be it enacted by the General Assembly of the State of South Carolina:

Dual officeholders for purposes of the Constitution

SECTION 1. Chapter 1 of Title 8 of the 1976 Code is amended by adding:

"Section 8-1-130. Any member of a lawfully and regularly organized fire department, county veterans affairs officer, constable, or municipal judge serving as attorney for another city is not considered to be a dual officeholder, by virtue of serving in that capacity, for the purposes of the Constitution of this State."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
