The House assembled at 10:00 A.M.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

O God, out of the uncertainties of this world we come into Your presence to pray. We are thankful for all that You constantly and without ceasing do for us. From these moments of prayer, send us forth to be better citizens of our beloved State. Give us patience, O Lord, lest we demand too much of others, lest we demand too much too soon, lest we become irritable when things do not go our way. Give us determination when the road becomes rocky, assuring us that Your strength is sufficient for every noble endeavor. Keep each of us enlisted in the ranks of those who serve God and mankind. Give us the assurance of the words of the Psalmist: "My defense is of God, Who saves the upright in heart" (Psalms 7:10).

In the Name of Jesus we pray. Amen.

After corrections to the Journal of the proceedings of Friday, the SPEAKER ordered it confirmed.

The Senate respectfully informs your Honorable Body that it has appointed Senator Garrison Vice Senator Saleeby of the Committee of Conference on the part of the Senate on H. 3890:
H. 3890 -- Reps. Edwards, Taylor, Keyserling, Cork and M.D. Burriss: A BILL TO PROVIDE THAT PRIOR TO AUTHORIZATION OF THE EXPENDITURE OF ANY OIL OVERCHARGE REFUND MONIES PURSUANT TO CERTAIN PROVISIONS OF LAW, THE JOINT LEGISLATIVE COMMITTEE ON ENERGY SHALL REVIEW AND MAKE A RECOMMENDATION AS TO THE APPROVAL AND ADOPTION OF THIS STATE'S ENERGY POLICY AND THE SPECIFIC USES FOR PROPOSED ENERGY CONSERVATION PROGRAMS, PROVIDE THAT THE USE OF THE FUNDS BE WITHIN CERTAIN RESTRICTIONS, GRANT THE COMMITTEE CONTINUOUS ENERGY PROGRAM OVERSIGHT REGARDING THE ACTUAL EXPENDITURE AND USE OF THE OIL OVERCHARGE FUNDS, PROVIDE FOR CERTAIN EVALUATION, PROVIDE FOR THE REPORTING OF CERTAIN COST SAVINGS, PROVIDE FOR THE DEPOSIT OF THESE FUNDS AND THEIR DISBURSEMENT, AND REQUIRE THE STATE AUDITOR TO CONDUCT AN ANNUAL FINANCIAL COMPLIANCE AUDIT.

CONCURRENT RESOLUTION

The following was introduced:

H. 4364 -- Rep. Harvin: A CONCURRENT RESOLUTION CONGRATULATING MR. AL GIBBONS, CERTIFIED PUBLIC ACCOUNTANT OF CLARENDON COUNTY, UPON BEING RECOGNIZED AND HONORED BY THE STATEWIDE JAYCEES AND FOR THE RECOGNITION AND HONORS RECEIVED BY THE MANNING CHAPTER OF THE JAYCEES, OF WHICH HE IS THE PRESIDENT.

The Concurrent Resolution was agreed to and ordered sent to the Senate.

Rep. HARVIN, from the Clarendon Delegation, submitted a favorable report, with amendments, on:

H. 4274 -- Rep. Harvin: A BILL TO PROVIDE FOR THE ELECTION OF THE MEMBERS OF THE BOARD OF TRUSTEES OF CLARENDON COUNTY SCHOOL DISTRICT NO. 1 FROM SINGLE-MEMBER DISTRICTS.

H. 4274--AMENDED AND ORDERED TO THIRD READING

On motion of Rep. HARVIN, with unanimous consent, the following Bill was taken up for immediate consideration.

H. 4274 -- Rep. Harvin: A BILL TO PROVIDE FOR THE ELECTION OF THE MEMBERS OF THE BOARD OF TRUSTEES OF CLARENDON COUNTY SCHOOL DISTRICT NO. 1 FROM SINGLE-MEMBER DISTRICTS.

Rep. HARVIN proposed the following Amendment No. 1 (Doc. No. 4476J), which was adopted.

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION 1. Sections 1 and 2 of Act 593 of 1986 are amended to read:

"Section 1. Each member of the Board of Trustees of School District No. 1 in Clarendon County must be elected in nonpartisan elections to be held and conducted in the manner provided by this act, except for three two members who must be appointed in the manner provided by this act.

The board of trustees must consist of nine members after the election in 1986, after the expiration of one appointed member's term and after the appointment in 1987, and after the expiration of two appointed members' terms and after the election and appointment in 1988; and seven members after the expiration of five four appointed members' terms and after the election and the appointments in 1989 and each year after 1989.

Section 2. The elected members of the board of trustees elected in 1986 must be elected from the school district at large in a nonpartisan election to be conducted at the same time as the general election of 1986 in the manner provided by this act.

After 1986, the elected members of the board of trustees must be elected from each of the four defined single-member election districts established by the General Assembly in nonpartisan elections to be conducted at the same time as the general election of the applicable year in the manner provided by this act.

Of the initial elections, Two two members must be elected in 1986, and one member two members must be elected in 1988, and one member must be elected in 1990 for terms of office of four years each. One member must be appointed by the county board of education subsequent to the expiration of the appointed member's term in 1987, one member must be elected in 1989 and two members must be appointed by the county board of education subsequent to the election in 1989 for terms of office of three years each. One member must be appointed by the county board of education subsequent to the expiration of the appointed member's term in 1988 only for one term of office of one year. After the initial elections and appointments, all members, except for the member appointed in 1988 only for one term of office of one year whose term expires in 1989, must be elected or appointed for terms of office of four years each. The members shall serve until their successors are elected or appointed and qualify.

Vacancies occurring on the board of trustees must be filled for the remainder of the unexpired term by appointment by the county board of education."

SECTION 2. The first paragraph of Section 4 of Act 593 of 1986 is amended to read:

"The at-large elected members of the board of trustees must be residents of the school district and must be elected from the district at large by the qualified electors of the district. The members of the board of trustees elected from defined single-member election districts must be residents of those election districts and must be elected by the qualified electors of those election districts. All persons desiring to qualify as candidates and be elected to the board of trustees shall file written notice of candidacy with the county board of education at least sixty days before the date set for the election but not earlier than ninety days prior to the election. This notice of candidacy must be a sworn statement and must include the candidate's name, age, voting precinct, period of residence in the district, and other information the county board of education requires. No filing fee may be required of any person desiring to qualify as a candidate."

SECTION 3. This act takes effect upon approval by the Governor./

Amend title to conform.

Rep. HARVIN proposed the following Amendment No. 2 (Doc. No. 4561J), which was adopted.

Amend the bill, as and if amended, by adding an appropriately numbered section to read:

/SECTION _____. Members of the Clarendon County Board of Education and employees of the board may be paid expenses from funds forwarded to the board for the position of county superintendent of education./

Renumber sections to conform.

Amend title to conform.

The Bill, as amended, was read the second time and ordered to third reading.
