A JOINT RESOLUTION DIRECTING THE STATE BUDGET AND CONTROL BOARD AND SOUTH CAROLINA DEPARTMENT OF CORRECTIONS TO PROCEED EXPEDITIOUSLY TO DESIGN AND CONSTRUCT A REPLACEMENT FACILITY IN LEE COUNTY FOR THE CENTRAL CORRECTIONAL INSTITUTION, TO PROVIDE THAT TWENTY-FOUR MILLION DOLLARS IN PREVIOUSLY AUTHORIZED STATE CAPITAL IMPROVEMENT BONDS MUST FIRST BE USED TO FINANCE THE PROJECT, TO PROVIDE FOR ADDITIONAL FUNDING AS MAY BE DETERMINED BY THE GENERAL ASSEMBLY, AND TO AUTHORIZE THE STATE TREASURER TO PROVIDE INTERIM FINANCING FOR NOT MORE THAN ONE YEAR, IF NECESSARY.

Be it enacted by the General Assembly of the State of South Carolina:

Findings

SECTION 1. The General Assembly finds that the State Budget and Control Board, pursuant to legislative authorization, has selected a site in Lee County in conjunction with the South Carolina Department of Corrections, for a correctional facility to replace the Central Correctional Institution located in Richland County. The board was authorized to finance the replacement of the Central Correctional Institution through a lease purchase agreement, under certain conditions, as provided in Section 1-11-400 of the 1976 Code. The board has now determined that the most effective and efficient method for financing the replacement facility is not through a lease purchase agreement, but rather through the use of state capital improvement bonds authorized in Act 638 of 1988 and other sources available to the General Assembly. The board has determined that these sources, among others, may be the Capital Reserve Fund, surplus funds, and proceeds from the sale of the property on which the Central Correctional Institution is currently located. It is the intent of the General Assembly that the State Budget and Control Board and the South Carolina Department of Corrections proceed with the construction of a one thousand two hundred-bed correctional facility in Lee County, at an estimated cost of fifty million dollars, to replace the Central Correctional Institution. It is further the intent of the General Assembly for the replacement facility to be financed through twenty-four million dollars of capital improvement bonds authorized in Section 1, Item 23., subitem (a) of Act 638 of 1988 as an eight hundred eight-bed medium/maximum security facility, with the balance of funds to be provided during construction from sources as may be determined by the General Assembly.

Replacement corrections facility

SECTION 2. The State Budget and Control Board and the South Carolina Department of Corrections are directed to proceed expeditiously with the design and construction of a replacement facility in Lee County for the Central Correctional Institution. To finance the project, the department shall first use twenty-four million dollars of state capital improvement bond funds provided in Section 1, Item 23., subitem (a) of Act 638 of 1988. Additional funding is to be provided from other sources as may be determined by the General Assembly. If interim financing is necessary, the State Treasurer may provide interim financing for not more than one year.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
