AN ACT TO AMEND SECTION 43-33-350, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWERS AND DUTIES OF THE PROTECTION AND ADVOCACY SYSTEM FOR THE HANDICAPPED, SO AS TO PROVIDE FOR THE INSPECTION OF A RESIDENTIAL FACILITY FOR DEVELOPMENTALLY DISABLED OR HANDICAPPED PERSONS AND THE INSPECTION REPORT.
Be it enacted by the General Assembly of the State of South Carolina:
Inspections of facilities for developmentally disabled and handicapped persons
SECTION 1. Section 43-33-350 of the 1976 Code, as last amended by Act 631 of 1988, is further amended by adding an appropriately numbered item to read:
"( ) It may conduct team advocacy inspections of a facility providing residence to a developmentally disabled or handicapped person. Inspections must be completed by the system's staff and trained volunteers. Team advocacy inspections are unannounced visits to review the living conditions of a residential facility. The system shall prepare a report based on the inspection which must be submitted to the Joint Legislative Committee on Mental Health and Mental Retardation, South Carolina Department of Health and Environmental Control, and State Department of Mental Health."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
