The House assembled at 10:00 A.M.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Eternal God, our Father, "always nearer to us than breathing and closer to us than hands and feet", we come into Your presence thankful for Your past blessings and to ask Your continued blessings. Help us to do our duties well, to carry with credit our responsibilities, and to make our decisions with sincerity of mind and genuineness of heart. Fill our thoughts with understanding that our service to You and to others would know no boundaries. Thus may we prove ourselves faithful to the trust imposed in us as we pray with the Psalmist: "Let integrity and uprightness preserve me; for I wait on Thee". Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

Amend the bill, as and if amended, p. 2, by deleting SECTION 3 in its entirety (i.e., lines 12 through 16).

The Labor, Commerce and Industry Committee proposed the following Amendment No. 1 (Doc. No. 1130o), which was adopted.

Amend the bill, as and if amended, in Section 59-102-20(A) of the 1976 Code by striking /to be set by the department not to exceed fifty dollars/ which begins on line 20 of page 2 and inserting /of three hundred dollars/.

When amended, Section 59-102-20(A) of the 1976 Code shall read:

/Section     59-102-20.     (A) Each athlete agent shall register biennially with the Department of Consumer Affairs on forms to be provided by the department and, at the same time, pay to the department a registration fee of three hundred dollars, for which the department shall issue a certificate of authority entitling the holder to operate as an athlete agent for two years. The department may revoke or suspend the registration of an athlete agent for cause or for a violation of any provision of this chapter./

Amend the bill further, as and if amended, in Section 59-102-30 of the 1976 Code by inserting after /enrolled/ on line 8 of page 3, line 28 of page 3, and line 44 of page 4 /and the Administrator of the Department of Consumer Affairs/; and by inserting after /UNIVERSITY/ on line 14 of page 4 /AND THE ADMINISTRATOR OF THE DEPARTMENT OF CONSUMER AFFAIRS/.

When amended, Section 59-102-30 of the 1976 Code shall read:

/Section 59-102-30.     (A) A student athlete who is subject to the rules and regulations of the National Collegiate Athletic Association, the National Association for Intercollegiate Athletics, or the National Junior College Athletic Association, who has not completed his last intercollegiate contest including postseason games for the applicable sport, and who enters into an agent contract with an athlete agent or a contract pursuant to which an athlete is employed as a professional athlete, shall notify the athletic director or the president of the college or university in which he is enrolled and the Administrator of the Department of Consumer Affairs that he has entered into such a contract. Written notification of entering into a contract must be given before practicing for or participating in an athletic event on behalf of a college or university or within seventy-two hours after entering into the contract, whichever occurs first. A student athlete who fails to provide this notification is guilty of a misdemeanor and, upon conviction, must be punished by a fine of one thousand dollars or by imprisonment for one year, or both.

(B)     An athlete agent who enters into an agent contract with a student athlete who is subject to the rules and regulations of the National Collegiate Athletic Association, the National Association for Intercollegiate Athletics, or the National Junior College Athletic Association shall notify the athletic director or the president of the college or university in which the student athlete is enrolled and the Administrator of the Department of Consumer Affairs that the student athlete has entered into such a contract. Written notification of the contract must be given before the student athlete's practicing for or participating in an athletic event on behalf of a college or university or within seventy-two hours after entering into the contract, whichever occurs first. An athlete agent who fails to provide this notification is guilty of a felony and, upon conviction, must be punished by a fine of five thousand dollars or by imprisonment for five years, or both.

(C)     A student athlete or athlete agent who enters into a contract before October 1, 1990, is subject to the notification requirements of this section as of October 1, 1990. Thereafter, they are subject to these notification requirements immediately in the manner required by this section.

(D)     An agent contract between a student athlete and an athlete agent must have a notice printed near the space for the student athlete's signature which must contain the following statement in ten-point boldfaced type:

'WARNING: IF YOU AS A STUDENT ATHLETE SIGN THIS CONTRACT, YOU MAY LOSE YOUR ELIGIBILITY TO COMPETE IN INTERCOLLEGIATE ATHLETICS. PURSUANT TO SOUTH CAROLINA LAW, YOU SHALL NOTIFY THE ATHLETIC DIRECTOR OR PRESIDENT OF YOUR COLLEGE OR UNIVERSITY AND THE ADMINISTRATOR OF THE DEPARTMENT OF CONSUMER AFFAIRS IN WRITING BEFORE PRACTICING FOR OR PARTICIPATING IN AN ATHLETIC EVENT ON BEHALF OF A COLLEGE OR UNIVERSITY OR WITHIN SEVENTY-TWO HOURS AFTER ENTERING INTO THIS CONTRACT, WHICHEVER OCCURS FIRST. FAILURE TO PROVIDE THIS NOTICE IS A CRIMINAL OFFENSE.'

(E)     An agent contract entered into between a student athlete and an athlete agent who fails to provide the notification required by this section is void and unenforceable.

(F)     A student athlete or athlete agent who enters into an agent contract and fails to provide the notification required by this section is liable for damages to the college or university in which the student athlete is enrolled that result from the student athlete's subsequent ineligibility. In addition to damages, if any, awarded pursuant to this section, damages may be assessed in an amount equal to three times the value of the athletic scholarship furnished by the institution to the student athlete during the student athlete's period of eligibility.

(G)     Within ten days after the date on which the contractual relationship between the athlete agent and the student athlete arises or after notification of the contractual relationship is received by the athletic director or president of the college or university in which the student is enrolled and the Administrator of the Department of Consumer Affairs, whichever occurs later, the student athlete has the right to rescind the contract or any contractual relationship with the athlete agent by giving notice in writing of his intent to rescind. The rescission is effective upon repayment by the student athlete to the athlete agent of any monetary amounts paid to the student athlete by the athlete agent, exclusive of travel, lodging, meals, and entertainment, or reimbursement for these items, furnished by the athlete agent to the student athlete. The student athlete may not effect a waiver of his right to rescind, and an attempt to do so is prohibited and unenforceable.

(H)     Postdating of agent contracts is prohibited, and a postdated contract is void and unenforceable. Execution of a postdated contract is a violation of this chapter, and an athlete agent committing the violation is subject to the penalty provisions of Section 59-102-20(C). A student athlete committing the violation is subject to the penalty provisions of Section 59-102-30(A)./

Amend the bill further, as and if amended, by adding a new section to be appropriately numbered which shall read:

/SECTION _____.Section 37-6-508 of the 1976 Code is amended to read:

"Section 37-6-508. The administrator, with the approval of the commission, may designate such a Deputy Administrator who deputies as he determines necessary to assist him in performing the duties he is required to perform under this title. Any deputy shall satisfy and meet the same qualifications, including bond, required for the administrator and who shall perform all of the duties required to be performed by the Administrator when the Administrator is absent or unable to act for any reason."/

Kirsh: A BILL TO AMEND ACT 148 OF 1989, AS AMENDED, RELATING TO THE AUTOMOBILE INSURANCE REFORM ACT OF 1989, SO AS TO DECREASE THE PER DIEM FINE FROM FIVE DOLLARS TO ONE DOLLAR AND THE TOTAL FINE FROM A MAXIMUM OF TWO HUNDRED TO THIRTY DOLLARS FOR A FIRST OFFENSE FOR A LAPSE IN AUTOMOBILE LIABILITY INSURANCE COVERAGE, AND PROVIDE THAT THIS FINE BE REMITTED TO THE REINSURANCE FACILITY INSTEAD OF THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION AND MUST BE INCLUDED IN THE DETERMINATION OF THE RECOUPMENT FEE.

The Labor, Commerce and Industry Committee proposed the following Amendment No. 1 (Doc. No. 1433X), which was adopted.

Amend the bill, as and if amended, by striking Section 36 of Act 148 of 1989, as contained in SECTION 1 of the bill, and inserting:

/"Section     36.     Whenever a person furnishes proof of liability insurance, or surrenders or has his registration or license tags confiscated for failure to produce proof of insurance, after the Department of Highways and Public Transportation receives notice of the lapse or termination of the required liability insurance, the department shall compare the effective date of the lapse or termination with the date of the proof of insurance or the date of the confiscation or surrender. If the department determines there was a lapse in the required coverage the department shall assess, in addition to other fines or penalties imposed by the law, a per diem fine in the amount of five dollars one dollar. However, the per diem fine does not apply to a first offense violation. The department shall collect and keep this fine to defer the costs of the financial responsibility program. The fine provided for in this section and the two hundred dollar reinstatement fee pursuant to Section 56-10-240 of the 1976 Code must not be assessed if the person furnishes proof, as documented by his sworn statement, that the motor vehicle upon which the coverage has lapsed or been terminated has not been operated upon the roads, streets, or highways of this State during the lapse or termination, and the lapse or termination is due to military service or illness as documented by a signed physician's statement. The total amount of the fine provided for in this section may not exceed two hundred dollars for a first offense. The Department of Highways and Public Transportation is directed to send, with the initial notice of cancellation, an additional notice of the applicable penalties for a first offense. This additional notice must also include warnings that violating this uninsured motorist provision entails criminal penalties as well as civil penalties. This notice must also include the alternative of turning in the motor vehicle license tags to avoid the penalties provided in this section. The penalties provided for in this section shall occur either (a) thirty days after the expiration of the insurance or (b) ten days from the date of the postmark of the warning that there has been a lapse in insurance coverage, whichever occurs later."/

The purposes of the Joint Assembly having been accomplished, the President announced that under the terms of the Concurrent Resolution the Joint Assembly would recede from business.

The Senate accordingly retired to its Chamber.

THE HOUSE RESUMES

At 2:14 P.M. the House resumed, the SPEAKER in the Chair.

Rep. WINSTEAD moved that the House do now adjourn, which was adopted.

ADJOURNMENT

At 2:15 P.M. the House in accordance with the motion of Rep. LITTLEJOHN adjourned in memory of John Erwin to meet at 10:00 A.M. tomorrow.
