The Senate assembled at 11:00 A.M., the hour to which it stood adjourned and was called to order by the PRESIDENT.

A quorum being present the proceedings were opened with a devotion by the Chaplain as follows:

Beloved, the prayer of St. Francis of Assisi, who lived forty-four years from 1182 A.D., has come down to us a classic of devotion. The deep spiritual motivations of all the faithful with a social conscience are expressed in this prayer.
Let us pray the "Prayer of St. Francis":

"Lord, make me an instrument of Thy peace;

Where there is hatred, let me sow love;

Where there is injury, pardon;

Where there is doubt, faith;

Where there is despair, hope;

Where there is darkness, light; and

Amend the bill, as and if amended, by striking all after the title and inserting in lieu thereof:

/WHEREAS, the General Assembly reaffirms its policy that landfilling is the least desirable method of disposing of hazardous waste; and

WHEREAS, the existing permitted commercial land disposal facility in South Carolina and available capacity in this State generally are limited resources; and

WHEREAS, it is essential that the limited waste treatment and disposal capacity of our existing commercial facility and the State in general be preserved, ready and available to ensure that the needs of South Carolina are met first; and

WHEREAS, the existing commercial landfill must give preference to South Carolina generators so as to decrease the capacity available to out-of-state waste; and

WHEREAS, the General Assembly and the Executive Branch have mandated restrictions on the importation of out-of-state wastes and on the capacity of existing hazardous waste landfills; and

WHEREAS, the final permit for the existing hazardous waste landfill facility does not contain a restriction on the importation of hazardous waste; and

WHEREAS, reducing the amount of hazardous waste shipped to South Carolina commercial facilities will send a message to all states that South Carolina intends to restrict access and will not continue to accept hazardous waste for purposes of disposal;

For these reasons, the State of South Carolina by amendment of Chapter 56 of Title 44 of the 1976 Code reduces the cap on the amount of hazardous waste disposed in South Carolina, restricts the transportation and disposal of out-of-state hazardous waste commercially landfilled in this State and promotes in-state
interests by giving preference to the disposal of hazardous waste generated within this State.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 44-56-60(a) of the 1976 Code is amended to read:

"(a) No person shall may construct, substantially alter, or operate any a hazardous waste treatment, storage, or disposal facility or site, nor shall any may a person transport, store, treat, or dispose of any hazardous waste without first obtaining a permit from the department for the facility, site, or activity. Beginning on July 1, 1985 1990, permitted hazardous waste disposal sites are restricted to a rate of land disposal by burial not to exceed one hundred thirty-five one hundred twenty thousand tons of hazardous waste. On July 1, 1991, and for each twelve-month period after that date, permitted hazardous waste disposal sites are restricted to a rate of land disposal by burial not to exceed one hundred ten thousand tons of hazardous waste for each twelve-month period thereafter within the permitted area of the site. Provided, however, that the commissioner may allow burial of waste in excess of that year's limitation, upon certification that disposal, by land burial from a particular site, is necessary to protect the health and safety of the people of this State. During a twelve-month period, the commissioner may allow land disposal by burial in excess of the limitation, upon certification of the department that:
(1) disposal by land burial at a site is necessary to dispose of hazardous waste generated in South Carolina; or
(2) at least one hundred ten thousand tons of hazardous waste disposed of by land burial in this State during the twelve-month period was generated in South Carolina.
During each twelve-month period, a person operating a hazardous waste disposal facility or site shall reserve at least the same capacity to dispose of hazardous waste generated in South Carolina that was disposed of by burial at that facility or site during the previous year.
Certification must be issued to the party seeking to use land disposal of the waste, and the certification must be presented to the operator of the facility at the time of disposal. The facility shall submit this certification with its regular report to the department of permitted activity at the disposal site."

SECTION 2. This act takes effect upon approval by the Governor./
