TO PROVIDE THAT THE MEMBERS OF THE BOARD OF EXAMINERS FOR NURSING HOME ADMINISTRATORS AND COMMUNITY RESIDENTIAL CARE FACILITY ADMINISTRATORS BEGIN TO SERVE UPON APPOINTMENT BUT THAT THE TIME FOR CALCULATING THEIR INITIAL STAGGERED TERMS DOES NOT BEGIN TO RUN UNTIL ALL MEMBERS OF THE BOARD ARE APPOINTED; TO PROVIDE THAT CERTAIN MEMBERS OF THE NURSING HOME ADMINISTRATORS BOARD SHALL SERVE AS EX OFFICIO MEMBERS OF THIS BOARD; TO PROVIDE THAT UNTIL REGULATIONS ARE PROMULGATED BY THIS BOARD, NURSING HOME ADMINISTRATORS SHALL MEET LICENSING STANDARDS AS PROVIDED FOR BY LAW PRIOR TO THE CREATION OF THIS BOARD AND THAT COMMUNITY RESIDENTIAL CARE FACILITY ADMINISTRATORS MAY NOT BE LICENSED UNDER ACT 605 OF 1990; TO PROVIDE FOR A TEMPORARY FEE SCHEDULE FOR NURSING HOME ADMINISTRATORS AND TO REQUIRE COMMUNITY RESIDENTIAL CARE FACILITY ADMINISTRATORS TO OBTAIN TEMPORARY LICENSES AND TO SET THE FEE FOR THIS TEMPORARY LICENSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) Notwithstanding the provisions of Section 3 of Act 605 of 1990:
(1) Members of the Board of Examiners for Nursing Home Administrators and Community Residential Care Facility Administrators appointed pursuant to Act 605 of 1990 begin to serve upon appointment but calculation of the time for their initial terms as follow does not begin to run until all members of the board are appointed: one nursing home administrator and one community residential care facility administrator for a one-year term; one nursing home administrator and one community residential care facility administrator for a two-year term; one nursing home administrator and one community residential care facility administrator for a three-year term; one consumer or sponsor or family member of a consumer of nursing home services for a one-year term; one consumer or sponsor or family member of a consumer of residential care services for a two-year term; and the member from the Long Term Care Council for a three-year term.
(2) Until January 31, 1993, the following members of the Nursing Home Administrators Board immediately prior to the effective date of Act 605 of 1990 shall serve as nonvoting ex officio members of the Board of Examiners for Nursing Home Administrators and Community Residential Care Facility Administrators: the medical doctor or nurse educator, the Commissioner of the Department of Social Services or his designee, and the Director of the Commission on Aging or his designee.
(3) Until regulations are promulgated under Act 605 of 1990, nursing home administrators must continue to meet the licensing standards and requirements in the manner provided by law and regulation existing on the effective date of Act 605 of 1990 and community residential care facility administrators must not be licensed or subject to the provisions of Act 605 of 1990.
(4) Until regulations are promulgated under Act 605 of 1990, community residential care facility administrators who are operating community residential care facilities on this joint resolution's effective date must apply for and must be issued a temporary annual license by the Board of Examiners for Nursing Home and Community Residential Care Facility Administrators for a fee of one hundred fifty dollars.
(B) Notwithstanding any other provision of law, until regulations are promulgated under Act 605 of 1990, fees and other applicable charges for nursing home administrators are:

SECTION 2. This joint resolution takes effect upon approval by the Governor.
