TO AMEND SECTION 7-13-1160, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REPORTING OF THE UNOFFICIAL RESULTS OF AN ELECTION TO THE STATE ELECTION COMMISSION, SO AS TO GIVE A CANDIDATE AND UP TO FOUR OF HIS REPRESENTATIVES THE RIGHT TO INSPECT CERTAIN ELECTION MATERIALS AFTER THE UNOFFICIAL RESULTS HAVE BEEN REPORTED BUT BEFORE THE TIME TO FILE PROTESTS HAS EXPIRED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 7-13-1160 of the 1976 Code is amended to read:
"Section 7-13-1160. Within twenty-four hours of the completion of the canvassing and counting of ballots, the persons in charge of each such election in each county shall notify the State Election Commission of the unofficial results of such the election in each such county; provided, however, that failure. Failure to comply with the provisions of this section shall does not invalidate the votes cast therein in the election.
After the unofficial results have been transmitted to the State Election Commission pursuant to this section but before the time to file protests has expired, the candidate and up to four of his representatives, upon written request to the commission and to the person in charge of the election in a particular county, must be given the opportunity to inspect the nonchallenged ballots, voter machine tabulation cards, and other election materials used in that county applicable to his election."
SECTION 2. This act takes effect upon approval by the Governor.
