AN ACT TO DIRECT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO CLOSE AND REMOVE FROM THE STATE HIGHWAY SYSTEM A PORTION OF ROAD S-33-256 IN MCCORMICK COUNTY, SUBJECT TO CERTAIN RIGHTS OF THE COMMISSION OF PUBLIC WORKS OF THE TOWN OF MCCORMICK.
Be it enacted by the General Assembly of the State of South Carolina:
Portion of road closed, removed; easements; gates and signs
SECTION 1. (A) The Department of Highways and Public Transportation shall close and remove from the state highway system in McCormick County that portion of Road S-33-256, as follows:
Commencing at a point where the centerline of Road S-33-256 intersects with the centerline of Road S-33-11; then running along the centerline of Road S-33-256 to a point three hundred forty-five feet from that intersection, in the center of South Carolina Road S-33-256, designated as "the point of beginning"; then turning and running south one degree zero minutes west for a distance of twenty-five feet to a point on the southern edge of the right-of-way of Road S-33-256; then turning and running south eighty-nine degrees east along the southern edge of the right-of-way along lands of F. Scott Rich, et ux, for a distance of approximately four hundred twenty feet to a point; then turning and running south eighty-five degrees east for a distance of approximately two hundred fifteen feet to a point where the southern edge of the right-of-way of Road S-33-256 intersects the western edge of the right-of-way of Road S-33-255; then turning and running north forty-five degrees thirty minutes east to a point where the northern edge of the right-of-way of Road S-33-256 intersects with the western edge of the right-of-way of Road S-33-255; then turning and running north eighty-five degrees west for a distance of approximately two hundred forty-nine and one-half feet along lands of F. Scott Rich, et ux, to a point; then turning and running north eighty-nine degrees west for a distance of approximately four hundred twenty feet along lands of F. Scott Rich, et ux, to a point; then turning and running south one degree zero minutes west for a distance of twenty-five feet to the point of the beginning, and containing seventy-two hundredths of an acre, more or less.
(B) The closure and the removal from the state highway system in McCormick County of the portion of Road S-33-256 described in subsection (A) are subject to the rights of the Commission of Public Works of the Town of McCormick, South Carolina, for an unrecorded easement for the transmission of electricity along the described roadway and also an underground easement for a water pipeline, as these easements exist on the effective date of this act.
(C) After closing of the portion of roadway described in subsection (A), the owners of the affected property may erect appropriate gates and signs on their side or sides of the closed roadway.
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
