TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-23-75 SO AS TO PROVIDE FOR THE ISSUANCE OF A DRIVER TRAINING VOUCHER AND THE REQUIREMENTS OF A DRIVER TRAINING COURSE; AND BY ADDING SECTION 56-3-810 SO AS TO INCREASE THE ANNUAL REGISTRATION AND LICENSE FEE BY TWO DOLLARS TO BE USED FOR DRIVER TRAINING VOUCHERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 56-23-75. (A) Upon request, the department shall issue to each driver's license applicant between the ages of fifteen and eighteen one driver training voucher. The amount of the voucher must be set by the General Assembly to defray the actual cost of providing driver training but not less than two hundred dollars. The department shall issue the driver training vouchers through the driver license examiner section and maintain a record of persons receiving vouchers for three years. Vouchers are valid for three years or until the holder's nineteenth birthday, whichever occurs first.
There must be one uniform voucher printed in triplicate on a form determined by the department. The voucher must contain the following information:
(1) holder's name and address;
(2) holder's birth date;
(3) holder's social security number;
(4) the date issued and expiration date;
(5) the signature of the holder;
(6) the name and address of the school district or driver training school;
(7) the use date;
(8) the signature of the school official; and
(9) validation date by the department.
The department may retain one dollar for each voucher issued to defray the cost of providing it.
(B) The driver education and training programs established by the school districts and the licensed driver training schools must consist of at least eight hours of classroom instruction to include at least two hours of instruction each on the following:
(1) seeing habits, steering habits, lane changing, traffic light habits, and acceleration and deceleration;
(2) traffic rules, regulations, and signs;
(3) care and maintenance of motor vehicles; and
(4) the effects drugs and alcohol have on the operation of motor vehicles and the consequences of drug or alcohol impaired driving.
In addition to the classroom instruction there must be at least six hours of behind the wheel training, including at least two hours of instruction each on the following:
(1) city traffic, checking cross traffic, and parking maneuvers;
(2) residential traffic with lane changes and traffic light maneuvers; and
(3) divided and undivided highway or expressway traffic with special emphasis on eye lead and following.
(C) Persons under eighteen years of age are required to complete the driver training program before obtaining a driver's license and to provide certification of completion to licensing officials of the department."
SECTION 2. The 1976 Code is amended by adding:
"Section 56-3-810. In addition to the annual registration and license fees specified in this article, the owner of every motor vehicle, trailer, semitrailer, pole trailer, and special motor vehicle shall pay to the department a driver training fee of two dollars. Driver training fees collected must be placed in a special driver training voucher account to be disbursed solely for these vouchers. The department may utilize one dollar of the fee for administration of the driver training voucher system."
SECTION 3. During the first year after the effective date of this act, Section 56-23-75 applies only to those persons fifteen years of age. During the second year after the effective date of this act, Section 56-23-75 applies to persons fifteen or sixteen years of age. The provisions of Section 56-23-75 apply to all persons under eighteen years of age, three years after the effective date of this act.
SECTION 4. This act takes effect upon approval by the Governor.
