TO AMEND SECTIONS 40-22-190 AND 40-22-200, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO QUALIFICATIONS FOR REGISTRATION AS A PROFESSIONAL ENGINEER AND AS AN ENGINEER-IN-TRAINING, SO AS TO REQUIRE THAT THE TRANSCRIPTS OF APPLICANTS EDUCATED OUTSIDE OF THE UNITED STATES MEET CERTAIN CRITERIA BECOME THE MINIMUM REGISTRATION QUALIFICATIONS AS OF A FUTURE DATE; AND TO AMEND SECTION 40-22-460, RELATING TO EXEMPTIONS FROM REGISTRATION OF ENGINEERS AND LAND SURVEYORS, SO AS TO CLARIFY THAT FEDERAL EMPLOYEES WORKING ON FEDERAL PROPERTY ARE EXEMPT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 40-22-190 of the 1976 Code, as added by Act 99 of 1991, is amended to read:
"Section 40-22-190. (A) To be eligible for registration as a professional engineer, an applicant must be of good character and reputation. When the evidence presented in the application does not appear to the board conclusive, nor warrant the issuing of a certificate of registration, the applicant may be required to present further evidence for the consideration of the board. The applicant must also meet the requirements of the other pertinent sections of this chapter.
(B) The minimum evidence satisfactory to the board that an applicant is qualified for registration as a professional engineer is:
(1) graduation in an EAC/ABET accredited engineering curriculum of four or more years from a school or college approved by the board as being in satisfactory standing, a specific record after graduation of an additional four or more years of progressive experience in engineering work of a character satisfactory to the board, indicating that the applicant is competent to practice engineering (in counting years of experience, the board, at its discretion, may give one year credit for satisfactory completion of a Master's Degree in Engineering or maximum credit of two years for satisfactory completion of the doctorate level degree in engineering), and passing of examinations required by the board; or
(2) graduation in an approved engineering or an approved related engineering science curriculum of four or more years, in a school or college other than those in item (1) of this section, a specific record after graduation of eight or more years of experience in engineering work of a character satisfactory to the board, indicating that the applicant is competent to practice engineering, passing of a written or oral examination designed to show knowledge and skill approximating that attained through graduation in an EAC/ABET accredited four-year engineering curriculum, and then passing of the written examinations required of applicants in item (1) of this section.
(C) Records of applicants educated outside the borders of the United States must have transcripts evaluated by an educational consultant employed by the board, and these transcripts are acceptable only if the engineering curriculum is found in the board's opinion to be substantially equivalent to that of an EAC/ABET accredited curriculum.
(D) After December 31, 2003, the criteria prescribed in subsection (B)(1) is the minimum evidence satisfactory for education, experience, and examination of applicants seeking registration as a professional engineer."
SECTION 2. Section 40-22-200 of the 1976 code, as added by Act 99 of 1991, is amended to read:
"Section 40-22-200. (A) The minimum evidence satisfactory to the board that an applicant is qualified for certification as an engineer-in-training is:
(1) graduation in an EAC/ABET accredited engineering curriculum of four or more scholastic years from a school or college approved by the board as being in satisfactory standing and passing of a written examination as required by the board; or
(2) graduation in an approved engineering or an approved related engineering science curriculum of four or more years in a school or college other than those approved by the board in item (1) of this section, a specific record after graduation of four or more years experience in engineering work of a character satisfactory to the board and passing written examinations in engineering subjects designed to show knowledge and skill approximating that attained through graduation in an EAC/ABET accredited engineering curriculum, and passing of the examination as required in item (1) of this section.
(B) Records of applicants educated outside the borders of the United States must have transcripts evaluated by an educational consultant employed by the board, and these transcripts are acceptable only if the engineering curriculum is found in the board's opinion to be substantially equivalent to that of an EAC/ABET accredited curriculum.
(C) After December 31, 1995, the criteria prescribed in subsection (A)(1) is the minimum evidence satisfactory for education and examination of applicants seeking certification as an engineer-in-training."
SECTION 3. Section 40-22-460(A)(3) of the 1976 Code, as added by Act 99 of 1991, is amended to read:
"(3) the practice of officers and employees of the government of the United States while engaged within this State on properties owned and controlled by the government of the United States and providing services related to these properties in the practice of engineering or land surveying for the government;".
SECTION 4. This act takes effect upon approval by the Governor.
