TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-61-60 SO AS TO PROHIBIT THE CANCELLATION OF OR REFUSAL TO WRITE OR RENEW INSURANCE COVERAGE BASED ON CERTAIN FACTORS, REQUIRE WRITTEN REASONS FOR AN INSURER'S OR AGENT'S ACTION, AND PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-61-60. The cancellation of or refusal to write or renew insurance coverage based in whole or in part on race, sex, religion, national origin, economic status, credit history, residence, or lawful occupation is unlawful. An insurer or agent who cancels or refuses to write or renew insurance coverage shall provide the reasons for the action in writing. This section does not bar cancellation of insurance coverage for failure to pay premiums as agreed nor a refusal to provide credit or an installment payment plan for writing or renewing insurance coverage based upon credit history."
SECTION 2. This act takes effect upon approval by the Governor.
