TO AMEND SECTION 42-17-50, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO REVIEW AND REHEARING OF A WORKERS' COMPENSATION AWARD, SO AS TO PROVIDE THAT DURING AN APPEAL TO THE COMMISSION AN EMPLOYEE IS ENTITLED TO RECEIVE FIFTY PERCENT OF THE AWARD.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The first paragraph of Section 42-17-50 of the 1976 Code is amended to read:
"If an application for review is made to the commission within fourteen days from the date when notice of the award shall have been is given, the commission shall review the award and, if good grounds be are shown therefor, reconsider the evidence, receive further evidence, rehear the parties or their representatives, and, if proper, amend the award. If an application for review is made to the commission, an employee is entitled to receive fifty percent of the award until such time as the employer is required to pay the full award."
SECTION 2. This act takes effect upon approval by the Governor.
