We always need Your help, O Lord. But there are times when we need that help even more: such as this when we stand at the beginning of a new Legislative year. As we move into the demands that are heavy upon us, keep us strong; making us enduring knowing that a diamond is a chunk of coal made good under pressure. Teach us to understand unmistakably that the truths of the 10 Commandments and the Sermon on the Mount are not multiple choices. Forbid that we should hear without heeding, confess without changing, profess without practicing, worship without witnessing, get without giving.

We pray in praise and thanksgiving to our good and gracious God. Amen.

of November 6, 1990.

Danny Bruce was certified by the Spartanburg County Election Commission as the winner of this election. Judy Bradley protested and the Board of State Canvassers, by Order dated December 21, 1990, ordered a new election. Danny Bruce appeals from said Order on the following grounds:

(1)

The State Board of Canvassers (Board) erred in failing to apply the doctrine of the presumption of the validity of an election in its Order of December 21, 1990;

(2)

The Board erred in failing to apply correctly the doctrine of presumption of validity of an election in its Order of December 21, 1990;

(3)

The Board erred in finding and concluding that Protestant-Respondent met her burden of proof because there was insufficient evidence adduced below to prove voting improprieties which would case the election in doubt;

(4)

The Board erred in finding eight (8) improper votes in the House District 38 election because there was insufficient evidence adduced below to support such finding;

(5)

The Board erred in finding eight (8) improper votes in the House District 38 election on the basis of lay testimony without the benefit of testimony from the Board of Voter Registration;

(6)

The Board erred in finding the residence of seven (7) persons who are alleged to have been permitted to vote in House District 38 to be outside the boundaries of House District 38, because there was insufficient evidence adduced below to support such finding;

(7)

The Board erred in finding that seven (7) voters residing outside the boundaries of House District 38 actually voted in the House District 38 election, because there was insufficient evidence adduced below to support such finding;

(8)

The Board erred in finding that one (1) voter who was eligible to vote in House District 38 was not allowed to vote in House District 38 because there was insufficient evidence adduced below to support such finding;

(9)

The Board erred in failing to find and conclude that the failure of the Protestant-Respondent to challenge the alleged improprieties on or before election day estops the Protestant-Respondent from challenging said improprieties thereafter;

(10)

The Board erred in failing to find and conclude that by virtue of the Protestant-Respondent's failure to challenge improper votes prior to their being cast she has waived her right to challenge those votes after the election;

(11)

The Board erred in failing to find and conclude that the statutes setting out the procedure for challenging ballots is the Protestant-Respondent's only remedy;

(12)

The Board erred in failing to follow the procedure for the challenge of ballots as required by law;

(13)

The Board erred in failing to find and conclude that those voters whose votes were challenged at the hearing below were entitled to notice of the Protestant-Respondent's challenge and an opportunity to be heard on the validity of their votes;

(14)

The Board erred in failing to find and conclude that voter registration rolls are public information and available to the Protestant-Respondent prior to November 6, 1990, and, that, therefore, the Protestant-Respondent should have taken the precautions provided for by law to correct voter registration irregularities and to protect against improper voting on or before election day;

(15)

The Board erred in refusing to apply the after discovered evidence rule which, if applied, would have prevented the consideration of the Protestant-Respondent's alleged irregularities;

(16)

The Board erred in failing to find that the voter registration lists are public information and available to the Protestant-Respondent prior to November 6, 1990, therefore, any voter registration irregularities contained therein are not such as would constitute after discovered evidence sufficient to compel the overturning the election results;

(17)

The Board erred in determining that the election should be overturned because of the improper registration of eight (8) voters when, in fact, any such alleged errors are harmless errors;

(18)

The Board erred in failing to find and conclude that the voter registration errors, if any, were unintentional and not fraudulent and therefore should not have been deducted from the winning candidate's total;

(19)

The Board erred in failing to find and conclude that voter registration irregularities, if any, existed prior to Election Day and could have been discovered with reasonable diligence and could have been corrected prior to Election Day by the Protestant-Respondent;

(20)

The Board erred in concluding that there exists a presumption of law that voters actually vote in the election districts in which they are registered.

Kathleen Kempe was certified by the Spartanburg County Election Commission was the winner of this election. G. Ralph Davenport protested, and the Board of State Canvassers, by Order dated December 21, 1990, ordered a new election. Kathleen Kempe appeals from said Order on the following grounds:

(1)

The State Board of Canvassers (Board) erred in determining that 39 specified people resided outside of the District, when there was no evidence of current residence presented (the burden of proof being upon the Protestant).

(2)

The Board erred in determining residency of 39 specified persons, based solely upon street addresses obtained more than 20 years ago without updated information.

(3)

The Board erred in finding that the Protestant had proved residency of 39 specified persons, when in fact, there was insufficient evidence of residency for the Protestant to meet his burden of proof.

(4)

The Board erred in determining that the election should be overturned due to 39 persons being registered in error, when in fact, any such alleged errors, if errors at all, were harmless errors, and should have been considered as harmless errors.

(5)

The Board erred in failing to find that the 39 alleged registration errors, if errors at all, were not intentional, not willful, and not fraudulent on the part of any candidate, campaign, voter or election official (as conceded by the Protestant), and therefore should not have been deducted from the winning candidate.

(6)

The Board erred in applying a standard of deducting harmless registration technicalities from the winning candidate, when such alleged technicalities, if such existed, were not the type or degree of error to be deducted.

(7)

The Board erred in applying a standard of deducting from the winning candidate registration technicalities which were conceded to be unintentional, non-willful, and non-fraudulent, when such alleged technicalities, if such existed, were not the type or degree of error to be deducted.

(8)

The Board erred by considered the Protestant's challenges to voters which were not presented on or before election days as required by S.C. law and procedure.

(9)

The Board erred in failing to find that Protestant's 39 alleged irregularities had existed for 20 years or more and could have, with reasonable diligence, been presented to the Spartanburg County Election Commission on or before election day.

(10)

The Board erred in refusing to apply the after-acquired evidence rule, which, if applied, would have prevented consideration of Protestant's 39 alleged irregularities.

(11)

The Board erred in determining that such technicalities should be the basis for overturning a valid election, the error being that it is unreasonable to expect 100% registration accuracy in any election.

(12)

The Board erred in failing to consider that the statewide application of the standard used, that being to deduct harmless, non-intentional technicalities from the winning candidate, will result in the overturning of virtually every close election in the State of S.C., which is unreasonable.

(13)

The Board erred in failing to apply the well-settled presumption of the validity of an election.

(14)

The Board erred in failing to give greater weight to the sanctity of election results over and above harmless, unintentional technicalities.

ARC of S.C. has a membership of over 1,000 people, which includes family members, people with mental retardation, professionals, and friends. It is the largest and oldest parent/volunteer/advocacy organization for mental retardation in the State.

The S.C. Human Service Providers is made up of executive staff of county Mental Retardation Boards and other organizations. These Boards are comprised of more than 1,000 citizen volunteers who provide direction and support for local county mental retardation programs serving 8,000 citizens with mental retardation.

That the South Carolina Jaycees are authorized to use the Hall of the House of Representatives on Saturday and Sunday, January 19 and 20, 1991, if the House is not in statewide session on those days, for the purpose of involving the Jaycees in the legislative process and for the purpose of conducting a model legislature.

Be it further resolved that the Division of General Services is requested to provide for the underground parking facilities and the Blatt Building to be made available for reasonable use by the Jaycees and that the State House security forces provide assistance and access necessary for this meeting in accordance with previous procedures.

Wilder, Baxley and Manly: A CONCURRENT RESOLUTION TO DESIGNATE WEDNESDAY, MARCH 13, 1991, AS "CHILDREN WITH DISABILITIES DAY", TO ENDORSE THE "B.A.C.-COFFEE DAY FOR CHILDREN WITH DISABILITIES" PROJECT AND OTHER OUTSTANDING PROGRAMS OF THE EASTER SEAL SOCIETY OF SOUTH CAROLINA, AND TO PROVIDE FOR A JOINT SESSION OF THE GENERAL ASSEMBLY AT 12:00 NOON ON WEDNESDAY, MARCH 13, 1991, AT WHICH TIME THE STATE EASTER SEAL REPRESENTATIVES OR AMBASSADORS AND THEIR PARENTS WILL BE PRESENTED TO THE GENERAL ASSEMBLY.

Whereas, the Easter Seal Society has again embarked upon its most worthwhile project to raise funds for children with disabilities, culminating in the thirty-ninth annual "B.A.C.-Coffee Day for Children with Disabilities" in South Carolina on Good Friday, March 29, 1991; and

Whereas, under the statewide leadership of P. Charles LaRosa, Jr., State Easter Seal President, and Allen P. Corbett, State Campaign Chairman, ably assisted by Major John B. Lee, III, State President, Lieutenant Colonel Alton T. Morris, "B.A.C." Project Chairman and John L. Caudle, II, Executive Director, all from the South Carolina Law Enforcement Officers' Association, and Thomas L. Sponseller, Executive Director, Harold L. Corley, "B.A.C." Project Chairman, and J. Ryan Condon, President, from the South Carolina Restaurant Association, this program is destined to raise thousands of dollars to aid our very deserving children and assist them in overcoming their disabilities; and

Whereas, the "B.A.C." buttons go on sale on Friday, March 15, 1991; and

Whereas, the "B.A.C." project and all other programs of the Easter Seal Society deserve the support, merit, and praise of all citizens of the State. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That Wednesday, March 13, 1991, is designated "Children With Disabilities Day" in South Carolina and that Sammy Etheredge, son of Mr. and Mrs. Jordan Williams of Saluda County; Anthony Gregg, son of Julius Gregg and Vera Burns of Charleston County; Brooks W. Kay, son of Mr. and Mrs. Mark Kay of Anderson County; Ainesley Lowrimore, daughter of Mr. and Mrs. Henry Lowrimore of Georgetown County; Emily Anne Mason, daughter of Mr. and Mrs. Richard Harrington of Beaufort County; and John Smith, young adult of Richland County, who have been chosen to serve as State Easter Seal Ambassadors to represent all of our people with disabilities, be presented to the General Assembly, along with their parents, in a joint session in the Hall of the House of Representatives on Wednesday, March 13, 1991.

Be it further resolved that the General Assembly extends to the Easter Seal Society and its many dedicated supporters its sincere wishes for continued success in its many constructive and compassionate programs on behalf of people with disabilities.

Be it further resolved that a copy of this resolution be forwarded to Herman L. Shealy, Jr., Executive Director of the Easter Seal Society, for distribution to the state chairmen of the various phases of the Easter Seal campaign and the "B.A.C." project, as well as to the State Easter Seal Representatives themselves.

Wright: A BILL TO AMEND SECTION 12-7-1210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE TAX CREDIT ALLOWED ON A JOINT INCOME TAX RETURN FOR THE EARNED INCOME OF A SPOUSE, SO AS TO PROVIDE THAT THE CREDIT EQUALS THE DIFFERENCE BETWEEN THE SOUTH CAROLINA INCOME TAX DUE ON THE JOINT RETURN AND THE TOTAL OF THE TAX THAT WOULD BE DUE IF BOTH SPOUSES FILED SEPARATELY AND TO DELETE PROVISIONS LIMITING THE CREDIT TO EARNED INCOME, PROHIBITING THE CREDIT WHEN A TAXPAYER LIVES ABROAD OR IN GUAM, AMERICAN SAMOA, AND THE NORTHERN MARIANA ISLANDS, AND WHEN THE TAXPAYER FILES A NONRESIDENT RETURN.
