The House assembled at 10:00 A.M.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

O God, the Source and Inspiration of the true, the beautiful and the good, show us how to bring our highest impulses and noblest ambitions to fulfillment and fruition. Discipline our wayward desires as we yield ourselves to Your way. May our wills be more finely attuned to Your will, strong and steadfast. CONCURRENT RESOLUTION

The Senate sent to the House the following:

S. 1368 -- Senators Robert W. Hayes, Jr., Peeler and Hinson: A CONCURRENT RESOLUTION RECOGNIZING YORK COUNTY FOR ITS MANY ACCOMPLISHMENTS AND DECLARING MARCH 10, 1992, "YORK COUNTY DAY".

Whereas, the population of York County has grown twenty-three percent during the past ten years and has increased fifty-four percent from 1970 to a current population of 131,500; and

Whereas, retail sales in York County have increased thirty-one percent since 1986 to nearly 1.5 billion dollars in 1990; and

Whereas, a total of ten new companies have located to York County since 1990, providing a total investment of 7.9 million dollars and a total of 163 jobs; and

Whereas, eight existing York County industries expanded since 1990 for a total investment of 9.25 million dollars and 175 new jobs. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly recognize York County for its many accomplishments by declaring March 10, 1992, "York County Day".

Be it further resolved that a copy of this resolution be forwarded to each of the six Chambers of Commerce in York County.

The Concurrent Resolution was agreed to and ordered returned to the Senate with concurrence.

POINT OF ORDER

Rep. CROMER raised the Point of Order that Amendment No. 129 was out of order under Rule 5.3 as it did not relate directly to an appropriation being made for the fiscal year referred to in the Bill since the House had not passed it in Part II.

Rep. McABEE argued contra the Point in stating that Rule 5.3 related more directly to the permanent provisions in Part II and in order to affect the expenditure of funds in Part I then there would have to be a line item appropriation in Part I or a proviso that would direct how funds would be spent. He further argued that this Amendment did that by providing for the expenditure of funds.

The SPEAKER stated, citing Rule 5.3, that there were two parts to Rule 5.3 and that the first sentence stated that the Appropriation Bill shall include only provisions for appropriating funds, provisions affecting revenue, and rules, regulations, directives and procedures relative thereto and that the second sentence stated that no provision of an Appropriation Bill and no amendment thereto shall be in order unless its substantial effect is directly germane to these purposes. He further stated that the Rule stated that no provision shall be put in any permanent part of the Bill unless it relates directly with an appropriation being made or revenue provided therein for the fiscal year referred to in the Bill. He further stated that the Amendment was not relative to any appropriation in the Bill.

Rep. McABEE argued that the proviso was in fact an appropriation in that it provided that the assessment surcharges, penalties and otherwise allocated by law must be remitted to the Division of Local Government and therefore, appropriated money and met the test of the two points of the Rule.

Rep. L. MARTIN argued that the Amendment was inartfully drawn in that it did not specifically refer to a line item in the Budget and Control Board section of the Bill, but that the Division of Local Government was a line item in the Budget and Control Board section and that would be where the money would go.

The SPEAKER stated that it was a contingent appropriation and that it was not an appropriation of dollars. He further stated that if this was going to be done by proviso, then it would have to relate to the expenditure of funds in Part I of the Bill.

Rep. L. MARTIN further argued that it did relate to a line item.

The SPEAKER stated that it did not refer to a line item in that section and that it was a proviso and he sustained the Point of Order and ruled the Amendment out of order.
