Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

O God, Whose presence is always near and Whose wisdom is infallible, deliver us from self-deception and self-righteousness, from confusing our own selfish desires and ambitions with Your holy will, from indifference and overconfidence, from fear and worry and all dread of the future, from an attitude of defeatism or of compromise with the forces of evil. Grant to us a full measure of wisdom and understanding, courage and strength, faith and charity to meet all the challenges of our day.

Keep us in tune with Your holy Word which says: "Only fear the Lord and serve Him faithfully with all your heart." (I Samuel 12:24a) Amen.

The CONFERENCE COMMITTEE, to whom was referred:
S. 554 -- Senator Pope: A BILL TO AMEND CHAPTER 5, TITLE 22, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MAGISTRATE'S POWERS AND DUTIES IN CRIMINAL MATTERS, BY ADDING ARTICLE 11 SO AS TO PROVIDE THAT A PERSON CONVICTED OF A FIRST OFFENSE WITHIN THE JURISDICTION OF MAGISTRATE'S COURT MAY HAVE HIS CRIMINAL RECORD FOR THIS OFFENSE EXPUNGED UNDER CERTAIN CONDITIONS.
Beg leave to report that they have duly and carefully considered the same and recommend:

That the same do pass with the following amendments:

Amend the bill, as and if amended, by striking all after the enacting words and inserting therein the following:

/SECTION 1. Title 22, Chapter 5 of the 1976 Code is amended by adding:

"Article 11
Expungement of Criminal Records

Section 22-5-910.     Following a first offense conviction in a magistrate's court or a municipal court, the defendant after one year from the date of the conviction may apply, or cause someone acting on his behalf to apply, to the circuit court for an order expunging the records of the arrest and conviction. However, this section does not apply to an offense involving the operation of a motor vehicle or to a violation of Title 50 or the regulations promulgated thereunder for which points are assessed, suspension provided for, or enhanced penalties for subsequent offenses authorized. If the defendant has had no other conviction during the one-year period following the first offense conviction in a magistrate's court or a municipal court, the circuit court shall issue an order expunging the records. No person may have his records expunged under this section more than one time.

After the expungement, the South Carolina Law Enforcement Division is required to keep a nonpublic record of the offense and the date of the expungement to ensure that no person takes advantage of the rights of this section more than once. This nonpublic record is not subject to release under Section 34-11-95, the Freedom of Information Act, or any other provision of law except to those authorized law or court officials who need to know this information in order to prevent the rights afforded by this section from being taken advantage of more than once.

As used in this section, 'conviction' includes a guilty plea, a plea of nolo contendere, or the forfeiting of bail."

SECTION 2. This act takes effect upon approval by the Governor./

Whereas, the members of the House of Representatives believe it is appropriate to investigate this matter. Now, therefore,

That the House Ethics Committee is requested to investigate the report that votes were cast on Tuesday, May 5, 1992, by certain House members who were absent from the chamber when the vote was taken and to report its findings to the Speaker and the members of the House.

Whereas, as Vice-Chancellor, Dr. Koso-Thomas is the chief executive officer of the University of Sierra Leone and provides strategic leadership for those institutions; and

Whereas, the University of Sierra Leone is the only public institution of higher learning in Sierra Leone; and

Whereas, South Carolina State College has an exchange program with the University of Sierra Leone; and

Whereas, Dr. Koso-Thomas is visiting South Carolina State College and is the guest of Dr. Carl Wright of the School of Business. Now, therefore,

Be it resolved by the House of Representatives:

That the members of the House of Representatives welcome Dr. Kosoniki Koso-Thomas, Vice-Chancellor of the University of Sierra Leone, upon his visit to South Carolina State College and wish to recognize him on Wednesday, May 27, 1992.

Snow: A CONCURRENT RESOLUTION TO COMMEND THE HONORABLE ROBERT LINWOOD ALTMAN FOR HIS TRULY DISTINGUISHED SERVICE AS A MEMBER OF THE HOUSE OF REPRESENTATIVES FROM GEORGETOWN COUNTY AND FOR MANY YEARS OF PUBLIC SERVICE IN OTHER CAPACITIES UPON HIS RETIREMENT FROM THE SOUTH CAROLINA HOUSE OF REPRESENTATIVES.

Whereas, the members of the General Assembly have learned with deep regret that one of the most respected and well-liked members of the House of Representatives, Representative Linwood Altman from Georgetown County, has announced his intention not to seek re-election to the House in 1992; and

Whereas, Linwood Altman first began his service in the House in 1979 and has served continuously since this date and without question his legislative career is one of the most remarkable in terms of effectiveness in the history of the House; and

Whereas, he is a native of Georgetown County and currently resides in Pawleys Island. Before and after becoming a member of the House, he did as much or more than anyone to preserve the beauty and uniqueness of Pawleys. He chaired the Board of Trustees of the Pawleys Island Chapel which is a landmark of the South Carolina Low Country, and he served as Director of the Pawleys Island Civic Association which worked for the preservation of Pawleys Island prior to its incorporation as a municipality. He also served his home county of Georgetown in many other varied capacities including Chairman of the County Planning Commission, as a member of the County Board of Education, and as a member of the County Recreation Commission. In recognition of his service as a local and state public official, he has received many awards and honors including being named Georgetown Jaycee of the Year and receiving the Brookgreen Medal in recognition of his contributions in helping to protect and preserve Brookgreen Gardens which is known internationally for having some of the world's most famous outdoor sculptures and flora; and

Whereas, when he became a member of the House of Representatives in 1979, he moved into his role as a state legislator with confidence and integrity. Linwood Altman is respected throughout the General Assembly as a quiet, forceful, and influential member who has been an effective voice for business, industry, and economic development in South Carolina while at the same time fairly considering all needs and concerns of the various constituents in South Carolina; and

Whereas, his efforts and hard work were rewarded with many considerable accomplishments. For example, as a member of the State Highway Commission and as Chairman of the Grand Strand Area Transportation Policy Committee, he played a key role in the establishment of the SHIMS Program and the construction of the Highway 521 corridor from the Grand Strand area of our State; and

Whereas, he also cares deeply about South Carolina's pristine environment and natural beauty. He played a major role in enacting into law the Beachfront Management Act and as a member of the Coastal Council and the Wildlife and Marine Resources Commission constantly sought to protect South Carolina's precious gifts for future generations; and

Whereas, in all his endeavors he has been supported by his lovely wife, Nancy, to whom he has been married thirty-seven years and with whom he raised three fine children; and

Whereas, South Carolina is a better place to live and work in part due to the unselfish contributions of this dedicated public servant and members of the General Assembly, by this resolution, on behalf of the people of Georgetown County and the State of South Carolina would like to publicly recognize and thank him for all that he has done as a state and local public official upon the occasion of his retirement from the House of Representatives. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the General Assembly hereby commend the Honorable Robert Linwood Altman for his truly distinguished service as a member of the House of Representatives from Georgetown County and for many years of public service in other capacities upon his retirement from the South Carolina House of Representatives.

Amend the bill, as and if amended, by striking SECTION 1, page 1 and inserting:

/SECTION 1.     Chapter 1, Title 39 of the 1976 Code is amended by adding:

"Section 39-1-80.     (A)     A licensed health care professional may not refer a patient for treatment, testing, services, or products to any facility or entity in which he has a financial interest, other than a corporation in which the ownership interest is not greater than one percent, unless he first notifies the patient in writing of the nature of the financial interest. The provisions of this section do not apply to emergency referrals or admissions.

(B)     Annually on or before the date provided by law for the filing of state individual income tax returns, not including any extension allowed, a licensed health care professional shall file a statement of economic interest with his licensing board detailing any financial interest he may have in any entity which would require him to provide the notice required pursuant to subsection (A) of this section. The reporting period for the statement is the calendar year preceding the filing date. No statement is required to be filed by a licensed health care professional who, during the applicable reporting period, had no such financial interest.

(C)     A licensed health care professional who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than five hundred dollars nor more than one thousand dollars. Each violation constitutes a separate offense for purposes of this section."/

Martin and McAbee: A CONCURRENT RESOLUTION TO FIX 12:00 NOON ON WEDNESDAY, MAY 13, 1992, AS THE TIME FOR THE HOUSE OF REPRESENTATIVES AND THE SENATE TO MEET IN JOINT SESSION IN THE HALL OF THE HOUSE OF REPRESENTATIVES FOR THE PURPOSE OF ELECTING MEMBERS OF THE BOARDS OF TRUSTEES OF LANDER COLLEGE, THE MEDICAL UNIVERSITY OF SOUTH CAROLINA, THE COLLEGE OF CHARLESTON, WINTHROP UNIVERSITY, FRANCIS MARION UNIVERSITY, SOUTH CAROLINA STATE UNIVERSITY, AND THE WIL LOU GRAY OPPORTUNITY SCHOOL, AND THE BOARD OF VISITORS OF THE CITADEL, TO SUCCEED THOSE MEMBERS WHOSE TERMS EXPIRE IN 1992 OR WHOSE POSITIONS OTHERWISE MUST BE FILLED.
