TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 39-1-80 SO AS TO PROVIDE THAT A LICENSED HEALTH CARE PROFESSIONAL MAY NOT REFER A PATIENT FOR TREATMENT OR TESTS TO A FACILITY OR ENTITY IN WHICH THE HEALTH CARE PROFESSIONAL HAS A FINANCIAL INTEREST UNLESS THE PATIENT IS NOTIFIED IN WRITING OF THE NATURE OF THE FINANCIAL INTEREST AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 39-1-80. A licensed health care professional may not refer a patient for treatment or testing to a facility or entity in which the health care professional has a financial interest unless the health care professional first notifies the patient in writing of the nature of the financial interest. This section does not apply to emergency referrals or admissions."
SECTION 2. This act takes effect July 1, 1993, and applies with respect to referrals occurring after June 30, 1993.
