TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-19-91 SO AS TO PROVIDE THAT SCHOOL TRUSTEES SHALL DEVELOP AND IMPLEMENT A POLICY, REGULATIONS, AND GUIDELINES ALLOWING SCHOOL AUTHORITIES TO SEARCH PERSONS OR PROPERTY ON SCHOOL PREMISES FOR WEAPONS OR DRUGS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-19-91. In addition to other powers provided by law, school trustees must develop and implement a policy, regulations, and guidelines to allow school authorities to search without a warrant persons or property entering school premises for weapons or illegal drugs. Until the school trustees have developed this policy, school authorities may conduct a search of all persons or property entering school premises after notifying the board of trustees of the school district. School authorities shall follow other policies and procedures provided by law if a weapon or illegal drug is found."
SECTION 2. This act takes effect upon approval by the Governor.
