TO AMEND SECTION 38-33-290, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROVISION OF LAW THAT NO HEALTH MAINTENANCE ORGANIZATION MAY PROHIBIT ANY LICENSED PHYSICIAN, PODIATRIST, OPTOMETRIST, OR ORAL SURGEON FROM PARTICIPATING AS A PROVIDER IN THE ORGANIZATION ON THE BASIS OF HIS PROFESSION, SO AS TO INCLUDE A LICENSED OPTICIAN IN THIS GROUP OF PROVIDERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 38-33-290 of the 1976 Code is amended to read:
"Section 38-33-290. No health maintenance organization may prohibit any licensed physician, podiatrist, optometrist, optician, or oral surgeon from participating as a provider in the organization on the basis of his profession. Nothing in this section may be construed to interfere in any way with the medical decision of the primary health care provider to use or not use any health professional on a case-by-case basis."
SECTION 2. This act takes effect upon approval by the Governor.
