TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 7-13-365 SO AS TO PROVIDE A PROCEDURE FOR ALLOWING WRITE-IN VOTING FOR PRESIDENT AND VICE PRESIDENT; TO AMEND SECTION 7-13-360 RELATING TO WRITE-IN BALLOTS, SO AS TO DELETE THE PROHIBITION ON ALLOWING WRITE-IN VOTING FOR PRESIDENT AND VICE PRESIDENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 7-13-365. In any year in which presidential electors are to be elected, not later than the sixtieth day prior to the date of the election, there may be filed with the State Election Commission, in a form to be prescribed by it, a list of names and addresses of candidates for these electors. The list must contain the names and addresses of a candidate for president and vice president to whom these electors are pledged in writing. The list must contain the written acceptance of each candidate for presidential elector, who must be a qualified voter, and the written acceptance of the presidential and vice presidential candidates, who must be candidates other than those whose names are to be printed upon the official ballot. The commission shall certify the names of the candidates designated by the list for the offices of president and vice president and the form of write-in ballot for candidate which is considered acceptable."
SECTION 2. Section 7-13-360 of the 1976 Code is amended to read:
"Section 7-13-360. The ballots shall must also contain a place for voters to write in the name of any other person for whom they wish to vote except on ballots for the election of the President and Vice President."
SECTION 3. This act takes effect upon approval by the Governor.
