TO AMEND CHAPTER 12, TITLE 58, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CABLE TELEVISION, BY ADDING SECTION 58-12-140 SO AS TO PROVIDE THAT A CABLE TELEVISION COMPANY MAY NOT CHARGE A PENALTY FOR A LATE PAYMENT WHEN THE COMPANY BILLS AND COLLECTS ITS MONTHLY CHARGE FOR SERVICES IN ADVANCE, AND PROVIDE A FINE FOR EACH VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 12, Title 58 of the 1976 Code is amended by adding:
"Section 58-12-140. (A) No cable television company may charge a penalty for late payment of a monthly fee for services when the company bills and collects its monthly charge in advance of the service being provided.
(B) Any company violating the provisions of this section must be fined one thousand dollars for each violation by the governing body of a political subdivision which grants the franchise to the company."
SECTION 2. This act takes effect upon approval by the Governor.
