TO PROVIDE A PROCEDURE WHEREBY ANY MUNICIPAL FIRE DEPARTMENT, FIRE DISTRICT, FIRE PROTECTION AGENCY, OR OTHER EMERGENCY SERVICE ENTITY MAY PROVIDE MUTUAL AID ASSISTANCE, UPON REQUEST, FROM ANY OTHER MUNICIPAL FIRE DEPARTMENT, FIRE DISTRICT, FIRE PROTECTION AGENCY, OR OTHER EMERGENCY SERVICE DELIVERY SYSTEM IN SOUTH CAROLINA AT THE TIME OF A SIGNIFICANT INCIDENT SUCH AS FIRE, EARTHQUAKE, OR HURRICANE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Any municipal fire department, fire district, fire protection agency, or other emergency service entity may provide mutual aid assistance, upon request, from any other municipal fire department, fire district, fire protection agency, or other emergency service delivery system in South Carolina at the time of a significant incident such as fire, earthquake, hurricane, flood, tornado, hazardous material event, or other such disaster. The chief or highest ranking officer may, with the approval and consent of the governing body, provide this assistance while acting in accordance with the policies, ordinances, and procedures set forth by the governing body of the providing governmental entity.
SECTION 2. Any municipal fire department, fire district, fire protection agency, or other emergency service entity requesting mutual aid assistance from any emergency service delivery system in South Carolina shall utilize an incident commander, and the Incident Command System, at all emergency incidents.
SECTION 3. When providing mutual aid, any municipal fire department, fire district, fire protection agency, or other emergency service entity must be properly trained and equipped and is subject to all provisions of federal, state, or local laws which govern the incident location.
SECTION 4. The provisions of this act shall not conflict with any existing or future mutual aid agreements or contracts between fire departments, agencies, or other entities.
SECTION 5. No municipal fire department, fire district, fire protection agency, or other emergency service entity which provides mutual aid assistance pursuant to this act, and no employee, member, agent, or representative of such department, district, agency, or entity while engaged in such mutual aid assistance, may be held liable for any damage or injury resulting from his participation in such mutual aid assistance.
SECTION 6. This act takes effect upon approval by the Governor.
