TO APPROPRIATE AN AMOUNT NOT TO EXCEED THIRTY-FOUR MILLION, SEVEN HUNDRED SIXTEEN THOUSAND, ONE HUNDRED FIFTY EIGHT DOLLARS FROM THE FUNDS AVAILABLE FROM THE FISCAL YEAR 1992-93 REVENUE SURPLUS FOR THE PURPOSE OF PROVIDING FUNDS FOR THE SETTLEMENT OR FINAL RESOLUTION OF BASS VS. THE STATE OF SOUTH CAROLINA AND TO DIRECT THAT ANY SETTLEMENT OR EXPENDITURE FROM THIS SPECIAL ACCOUNT MUST BE APPROVED BY THE GENERAL ASSEMBLY IN SUBSEQUENT LEGISLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The following appropriation is made from the funds available from the fiscal year 1992-93 revenue surplus:
Settlement of Bass
vs. State of South Carolina $34,716,158.
SECTION 2. These funds shall be held in an identifiable account by the State Treasurer pending settlement or other final resolution of Bass vs. State of South Carolina.
This resolution shall not be construed as authorizing or committing the State to any specific course of action. Any settlement or expenditure of funds may only be effectuated as authorized or approved by the General Assembly in subsequent legislation.
Upon final disbursement, should funds remain in this account, the General Assembly may appropriate the funds for other purposes.
SECTION 3. This act takes effect upon approval by the Governor.
