Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Almighty and eternal God, the Father of all mankind, make us continually aware of Your presence and obedient to Your will. Keep us true to Your teachings that we be unafraid or unashamed to look into Your holy face. When we are inclined to doubt, steady our faith; when we are tempted, make us strong to resist; when we miss the mark of attaining the best, give us the determination to try again. Guide us with the light of Your Word that we may be more than conquerors by God's help Who created us to serve Him even as we serve His people.

We thank You Lord, for Your assurance to hear our prayers, and to answer according to Your wisdom. Amen.

S. 446 -- Senators Hayes, Peeler, Short and Gregory: A CONCURRENT RESOLUTION RECOGNIZING YORK COUNTY FOR ITS MANY ACCOMPLISHMENTS AND DECLARING MARCH 2, 1993, "YORK COUNTY DAY".

Whereas, the population of York County has grown twenty-three percent during the past ten years and has increased fifty-four percent to a current population of 131,500; and

Whereas, the tax base of York County has grown by twenty-five percent the past year and forty-seven percent since 1987, as a result of positive growth, new homes, new businesses, developed property, improved residential and commercial properties; and

Whereas, gross retail sales in York County have increased fifty-one percent since 1986 to over 1.5 billion dollars in 1991; and

Whereas, a total of seven new companies announced plans to locate in York County in 1992, providing a total investment of 94.2 million dollars and a total of eleven-hundred five jobs; and

Whereas, nine existing York County industries expanded in 1992 for a total investment of 201.85 million dollars and fifty-five new jobs. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly recognize York County for its many accomplishments by declaring March 2, 1993, "York County Day".

Be it further resolved that a copy of this resolution be forwarded to each of the six Chambers of Commerce in York County.

Whereas, W. E. Spearman, Sr., was a lifelong resident of Chappells, served on the Chappells Town Council for many years and during his life was a business and civic leader in Chappells as well as in Newberry and Saluda Counties; and

Whereas, for forty years he served as the Chappells Depot Manager at the railway station located just beneath the Saluda River Bridge on Highway 39; and

Whereas, his home which was located on the top of a surrounding hill gave him a clear view of this bridge and the town he loved so well; and

Whereas, after his death when the bridge needed to be rebuilt, part of his estate was sold to the State of South Carolina so that this could be accomplished; and

Whereas, the members of the General Assembly believe it would be a fitting tribute to this fine South Carolinian if this bridge was named in his honor. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the General Assembly hereby request the State Highways and Public Transportation Commission to name the Saluda River Bridge on Highway 39 at Chappells in honor of W. E. Spearman, Sr.

Whereas, the United States Secretary of Agriculture under the Bush Administration proposed, just before leaving office in January, to restructure the Department of Agriculture by sharply cutting its number of agencies and field offices; and

Whereas, the new Secretary of Agriculture, the Honorable Mike Espy of Mississippi, has these proposals under review; and

Whereas, the Department of Agriculture is in the process of determining which local county offices it will close or relocate to other counties; and

Whereas, these officers include those of the Farmers Home Administration, the United States Soil Conservation Service, and Agricultural Stabilization and Conservation Service; and

Whereas, if certain local county offices in rural areas are shut down or moved to more distant counties, people will have to travel great distances for assistance with their needs, thereby causing severe hardship especially for low-income persons; and

Whereas, it is hoped that consideration for closing offices will be given with respect to larger programs before considering a plan that would be detrimental to rural counties across the country. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the General Assembly of the State of South Carolina, by this resolution, memorializes Congress to act as may be necessary to avoid the closing of Department of Agriculture offices where the impact of such closing on rural counties would be detrimental.

Be it further resolved that copies of this resolution be forwarded to the President of the United States Senate; the Speaker of the United States House of Representatives; the Honorable Mike Espy, United States Secretary of Agriculture; and all eight members of the South Carolina Congressional Delegation, all at Washington, D.C.

Whereas, according to the 1990 United States Census, 29.8 percent of the citizens of South Carolina are classified as African-Americans; and

Whereas, since the elections in 1970 of the first African-Americans to the General Assembly after Reconstruction, the number of African-American members has steadily increased to its current total of twenty-five, representing nearly fifteen percent of the total membership in the General Assembly; and

Whereas, lobbyists play a functional role in informing the General Assembly and state administrative agencies of the advantages and disadvantages related to the passage of legislation and the adoption of regulations and procedures; and

Whereas, the number of African-Americans employed as lobbyists is disparate with respect to the number of African-Americans in the general population and in the General Assembly, as there are currently only a few African-Americans among the estimated three hundred eighty-six lobbyists registered with the Secretary of State's Office; and

Whereas, the groups actually employing lobbyists are uniquely situated to increase the number of qualified African-Americans employed as lobbyists in South Carolina. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly strongly encourage the groups employing lobbyists to timely increase the number of qualified African-Americans employed as lobbyists to reflect the true make-up of South Carolina's society and our General Assembly and to implement recruiting programs designed to achieve this effect.

Be it further resolved that copies of this resolution be made available to all lobbyists' principals registered with the Secretary of State.

S. 243 -- Senators Wilson, Gregory, Russell, Cork, Ryberg, Drummond, J. Verne Smith and Giese: A CONCURRENT RESOLUTION MEMORIALIZING THE CONGRESS OF THE UNITED STATES TO PROPOSE AN AMENDMENT TO THE UNITED STATES CONSTITUTION ESTABLISHING A PRESIDENTIAL LINE ITEM VETO.

Whereas, despite various efforts to control the explosive growth of federal spending, the President has had insufficient authority with respect to the budgetary process; and

Whereas, the federal budget has not been balanced since 1969 and the national debt has increased fourteen-fold in the past ten years; and

Whereas, presidents of both political parties since the War Between the States have cited the need for greater presidential involvement in administering the budgetary affairs of the nation; and

Whereas, in forty-three states, including this State, the chief executive has the constitutional power to veto items of appropriation while approving other portions of the bill; and

Whereas, this power has been described by political scholars as a highly desirable one, and one which has had a positive effect on the operation of government; and

Whereas, under Article V of the United States Constitution, amendments to the Constitution may be proposed by the Congress whenever two-thirds of both houses consider it necessary, or, on the application of the legislatures of two-thirds of the several states, the Congress shall call a Constitutional Convention for the purpose of proposing amendments. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the General Assembly of the State of South Carolina respectfully memorializes the Congress of the United States to propose an amendment to the United States Constitution, which would authorize the President of the United States to reduce or eliminate one or more items of appropriation while approving other portions of a bill.

Be it further resolved that the General Assembly of the State of South Carolina requests the Congress to submit to the several states the amendment to the Constitution of the United States for purposes of ratification; and

Be it further resolved that the General Assembly of the State of South Carolina also proposes that the legislatures of each of the several states comprising the United States apply to the Congress requesting the enactment of an amendment to the United States Constitution, as described in this resolution; and

Be it further resolved that copies of this resolution be transmitted to the President and Vice-President of the United States, to the Speaker of the House of Representatives, to each member of the South Carolina Congressional Delegation, to the Clerk of the United States House of Representatives, and to the Secretary of the United States Senate.

S. 404 -- Senator Courson: A CONCURRENT RESOLUTION TO DECLARE FEBRUARY 22-28, 1993, AS "TEENAGE PREGNANCY PREVENTION AWARENESS WEEK".

Whereas, teenage pregnancy has significant consequences on the health, economic, and educational future for teenagers and the people of South Carolina; and

Whereas, teenage parents often are unable to complete their education, which leads to unemployment, underemployment, and dependence on public welfare; and

Whereas, the cycle of poverty can be perpetuated from generation to generation; and

Whereas, the major responsibility of parenting alters a generation of young women and renders them the primary caretakers of families; and

Whereas, teenage mothers often seek late prenatal care, frequently suffering higher than average levels of toxemia, anemia, cervical trauma, premature delivery, and low birthweight babies; and

Whereas, the purpose of the South Carolina Teenage Pregnancy Prevention local councils is to advocate and support programs and strategies that prevent teenage pregnancy and decrease the problems associated with teenage pregnancy in South Carolina. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly, by this resolution, declare February 22-28, 1993, as "Teenage Pregnancy Prevention Awareness Week".

Be it further resolved that a copy of this resolution be forwarded to the Greater Columbia Teenage Pregnancy Prevention Council.

S. 408--ADOPTED AND SENT TO THE SENATE

The following Concurrent Resolution was taken up.

S. 408 -- Senator Holland: A CONCURRENT RESOLUTION TO REQUEST THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO DELAY ITS DECISION ON THE CLOSING OF THE DRIVERS' LICENSE OFFICE IN THE CITY OF PAGELAND IN CHESTERFIELD COUNTY AND TO MEET WITH THE CHESTERFIELD COUNTY DELEGATION AND THE LOCAL MUNICIPAL OFFICIALS TO SEEK AN ALTERNATIVE SOLUTION.

Whereas, the Department intends to close the Pageland Drivers' License office on February 23, 1993 and;

Whereas, the citizens of Pageland and the surrounding communities have come to rely on this vital service and;

Whereas, the officials of the city of Pageland and the Chesterfield county delegation realize that the current arrangement for providing these services is not cost-effective to the Department and;

Whereas, the Chesterfield county delegation and the city of Pageland would like to consult with the Department to explore the possibility of the city providing facilities in order to reduce the Department's cost and thereby maintaining this vial service. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That, the Department of Highways and Public Transportation is requested to delay its decision on the closing of the drivers' license office in the city of Pageland in Chesterfield county and is further requested to meet with the Chesterfield county delegation and the local municipal officials to seek an alternative solution.

Be it further resolved that a copy of this resolution be forwarded to the Executive Director of the Department of Highways and Public Transportation and to the City Council of Pageland.

The Concurrent Resolution was adopted and ordered returned to the Senate.

H. 3504--ADOPTED AND SENT TO THE SENATE

The following Concurrent Resolution was taken up.

H. 3504 -- Reps. Stuart, Cromer and Gamble: A CONCURRENT RESOLUTION MEMORIALIZING CONGRESS TO PROVIDE THE NECESSARY FUNDING FOR THE IMPLEMENTATION OF A SERVICE WHICH CONGRESS MANDATES A STATE, COUNTY, MUNICIPALITY, OR OTHER POLITICAL SUBDIVISION TO PROVIDE AND TO RELIEVE AND EXEMPT A STATE, COUNTY, MUNICIPALITY, OR OTHER POLITICAL SUBDIVISION FROM ALL ENFORCEMENT OBLIGATIONS OR DUTIES IN SUCH SITUATIONS.

Whereas, Congress has by legislation on various occasions required a state, county, municipality, or other political subdivision to implement or provide a service without, at the same time, providing the necessary funding for the state, county, municipality, or other political subdivision to implement or provide the service; and

Whereas, in such situations the financial burden for complying with the act of Congress has fallen squarely on the shoulders of the state, county, municipality, or other political subdivision and has become a burden which is too heavy to bear any longer; and

Whereas, if Congress wants a particular service to be provided at the state or local level, the Congress should in all fairness provide the necessary funds; if such funding cannot be found by Congress at the national level, the Congress should realize and understand that it would be even more difficult, if not impossible, for a state, county, municipality, or other political subdivision to provide the necessary funds; and

Whereas, enforcement obligations or duties imposed by Congress, in these situations, on the states, counties, municipalities, and other political subdivisions make it difficult for these governmental entities to function and perform their normal obligations in the federal system. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the General Assembly of the State of South Carolina, by this resolution, memorializes Congress to provide the necessary funding for the implementation of a service which Congress mandates a state, county, municipality, or other political subdivision to provide and to relieve and exempt a state, county, municipality, or other political subdivision from all enforcement obligations or duties in such situations.

Be it further resolved that copies of this resolution be forwarded to the President of the United States Senate, the Speaker of the United States House of Representatives, and all eight members of the South Carolina Congressional Delegation, all at Washington, D.C.

The Concurrent Resolution was adopted and ordered sent to the Senate.
