The Senate assembled at 12:00 Noon, the hour to which it stood adjourned and was called to order by the PRESIDENT.

A quorum being present the proceedings were opened with a devotion by the Chaplain as follows:

Our Father in heaven, as our voices become hushed and we bow before Thee for this moment at the beginning of another week, we open our hearts to Thy pervading presence.

We are so caught up with the business and the ambitions of our society that we, sometimes, are tempted to forget that Yours is a higher way... a way of sacrifice and cross-bearing.

Your values are the golden standard for our life, and we hanker, too, after the idolatries of the golden calf of olden times.

We thank You, Lord, for the good tidings that come to us from the sick room of Thy servant, Ed Saleeby. Continue, O Lord, Your blessing upon him --- and his family --- in body and soul.

Harwell, Chief Justice of the South Carolina Supreme Court whose term expires July 31, 1994; to elect a successor to the Honorable William H. Ballenger, circuit court judge of the Tenth Judicial Circuit whose term expires June 30, 1994; to elect a successor to the Honorable Thomas B. Barrineau, Jr., family court judge for the Sixth Judicial Circuit whose term expires June 30, 1996; to elect the Chief Judge of the Administrative Law Judge Division from Seat 1 whose initial term shall be for five years to begin March 1, 1994; to elect a judge of the Administrative Law Judge Division from Seat 2 whose initial term shall be for three years to begin March 1, 1994; and to elect a judge of the Administrative Law Judge Division from Seat 3 whose initial term shall be for one year to begin on March 1, 1994.

S. 1143 -- Senator Wilson: A CONCURRENT RESOLUTION PROCLAIMING FEBRUARY 27 THROUGH MARCH 5, 1994, AS "MIDLANDS FIGHTING BACK WEEK".

Whereas, over the past few years, thousands of citizens have joined forces to create Midlands FIGHTING BACK, a movement to combat alcohol and other drug abuse on a comprehensive scale by involving all segments of the community in Fairfield, Lexington, Newberry, and Richland counties; and

Whereas, families, youth, physicians, religious leaders, health care providers, educators, law enforcement, business leaders, government officials, the media, and other concerned citizens in all four counties have been working together to develop a comprehensive plan for the Midlands; and

Whereas, surveys have shown that sixty percent of Midlands youth have used alcohol and other drugs; and

Whereas, alcohol is a leading factor in individual and family crime and violence; and

Whereas, underage drinking is a primary health risk to youth in the Midlands; and

Whereas, each year in South Carolina, 3,350 children and adults die from alcohol and other drug-related tragedies; and

Whereas, the abuse of alcohol and other drugs affects everyone in the Midlands; and

Whereas, the citizens of Fairfield, Lexington, Newberry, and Richland counties are unwilling to let this tragedy continue without a fight. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That February 27 through March 5, 1994, is proclaimed Midlands FIGHTING BACK Week.

Be it further resolved that residents of the Midlands are called upon to participate in appropriate observances of the week.

Be it further resolved that a copy of this resolution be forwarded to Mr. James E. Brown, Regional Director, Midlands Fighting Back, PO Box 50597, Columbia, SC 29250.

"Section 12-45-90. (A) Taxes shall be are payable in the following kinds of funds by the following methods and no other: silver coin, United States currency and not more than five dollars in United States coins, United States postal money orders, and checks subject to collection. Jury certificates and per diem of witnesses in the circuit court and all county claims which have been approved and certificates issued by the governing body of the county in which such services were rendered or such claims approved, not including school taxes. The receiving official may elect to accept more than five dollars in coins.

(B) In addition to the methods of payment provided in subsection (A), the governing body of the county may elect to accept payment of property taxes by credit card. If a municipality or other political subdivision collects its own property taxes, the governing body of that governmental entity may elect to accept credit card payments of property taxes. If any political subdivision elects to accept credit card payment of property taxes, no discounting of the property taxes to pay fees associated with accepting credit card payments is permissible."/

Fair: A BILL TO AMEND SECTION 44-79-30, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PHYSICAL FITNESS SERVICE CREDIT CONTRACTS, SO AS TO INCREASE THE DURATION OF CONTRACTS FROM ONE TO THREE MONTHS AND THE AMOUNT FROM FIFTY DOLLARS TO FIFTY DOLLARS A MONTH FOR THOSE CONTRACTS THAT MUST CONFORM TO STATUTORY REQUIREMENTS; AND TO AMEND SECTION 44-79-80, AS AMENDED, RELATING TO CERTIFICATES OF AUTHORITY, SO AS TO REQUIRE THE POST OF THESE CERTIFICATES WITHIN VIEW OF THE FRONT ENTRANCE AND TO REQUIRE POSTING OF THE NUMBER OF COMPLAINTS FILED AGAINST THE CENTER.

On motion of Senator GIESE, the Bill was carried over.

S. 89 -- Senators McConnell and Rose: A BILL TO AMEND SECTIONS 7-13-330, 7-13-1340, AND 7-13-1640, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELECTIONS, SO AS TO DELETE THE PROVISIONS WHICH ALLOW STRAIGHT PARTY TICKET VOTING FROM GENERAL ELECTION BALLOTS, STRAIGHT PARTY TICKET VOTING ON ANY TYPE OF VOTE RECORDER, AND VOTING FOR ALL OF THE CANDIDATES OF ONE PARTY BY USE OF A VOTING MACHINE.

On motion of Senator McCONNELL, the Bill was carried over.

On motion of Senator RYBERG, with unanimous consent, the Senate stood adjourned out of respect to the memory of Mr. Carrol H. Warner, Chairman of the Aiken County Council, Aiken, S.C.
