TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-104-35 SO AS TO FORMULATE A PLAN FOR THE ALLOWABLE MAXIMUM EXPENDITURE OF STATE FUNDING FOR DEVELOPMENTAL EDUCATION BY THE FOUR-YEAR STATE-SUPPORTED INSTITUTIONS OF HIGHER LEARNING IN SOUTH CAROLINA BEGINNING WITH FISCAL YEAR 1995-96, TO PROVIDE FOR WHAT DEVELOPMENTAL EDUCATION ENCOMPASSES AND INCLUDES, AND TO REQUIRE THE COMMISSION ON HIGHER EDUCATION TO DETERMINE THE BASE AMOUNT OF STATE FUNDING USED BY THE AFFECTED INSTITUTIONS FOR DEVELOPMENTAL EDUCATION DURING FISCAL YEAR 1994-95.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-104-35. (A) Fiscal year 1994-95 constitutes the base year for determining the allowable amount of state funding which may be subsequently utilized by the four-year state-supported institutions of higher learning for developmental education. After fiscal year 1994-95, the allowable maximum amount of state funding which may be used by the affected institutions for developmental education is as follows:
(1) for fiscal year 1995-96, eighty percent of the amount so used during fiscal year 1994-95;
(2) for fiscal year 1996-97, seventy percent of the amount so used during fiscal year 1994-95;
(3) for fiscal year 1997-98, sixty percent of the amount so used during fiscal year 1994-95;
(4) for fiscal year 1998-99, fifty percent of the amount so used during fiscal year 1994-95;
(5) for fiscal year 1999-2000, forty percent of the amount so used during fiscal year 1994-95.
(B) Developmental education includes remedial education and encompasses all programs and courses, however styled or named, devoted either directly or indirectly, in whole or in part, to this type of education. The Commission on Higher Education shall determine the total amount of state funding applied toward developmental education by each of the four-year state-supported institutions of higher learning during fiscal year 1994-95, interpreting the term `developmental education' in the broadest possible sense for purposes of establishing the amount used for such education by each of the affected institutions during that fiscal year."
SECTION 2. This act takes effect upon approval by the Governor.
