TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 30-5-38 SO AS TO REQUIRE THAT DEEDS CONVEYING AN INTEREST IN LAND AND MORTGAGES OF REAL ESTATE INCLUDE THE TAX MAP NUMBER OF THE SUBJECT PROPERTY, AND PROVIDE FOR RELATED MATTERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 30-5-38. (A) All deeds conveying an interest in land executed after the effective date of this section shall include the tax map number of the subject property.
(B) A clerk of court or register of mesne conveyance shall not record any deed after the effective date of this section unless it contains the tax map number of the subject property as prescribed in subsection (A). However, the clerk of court or register of mesne conveyance may record a deed without such information upon a satisfactory showing that the information for such deed was not available.
(C) The provisions of this section are intended to be regulatory in nature and do not affect the legality, force, effect, or record notice of any instrument recorded in violation of this section."
SECTION 2. This act takes effect upon approval by the Governor.
