TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 9-1-870 AND 9-11-360 SO AS TO ALLOW EMPLOYERS UNDER THE SOUTH CAROLINA RETIREMENT SYSTEM AND THE SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM TO ELECT NOT TO MAKE EMPLOYER CONTRIBUTIONS FOR EMPLOYEES TO ESTABLISH NONMEMBER SERVICE, TO PROVIDE THAT THE ELECTION IS IRREVOCABLE, TO PROVIDE THAT THE ELECTION DOES NOT APPLY TO THE STATE, AND TO ALLOW EMPLOYEES OF ELECTING EMPLOYERS TO ESTABLISH CREDIT FOR NONMEMBER SERVICE BY PAYING BOTH THE EMPLOYEE AND EMPLOYER PAYMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7, Chapter 1, Title 9 of the 1976 Code is amended by adding:
"Section 9-1-870. Notwithstanding any other provisions of this chapter, an employer other than the State may elect not to make the employer contribution required for an employee to establish nonmember service. Once made, this election is irrrevocable and applies for all employees. An employee of an electing employer may nevertheless establish nonmember service in the manner provided in this chapter by paying both the employee and employer share of the payment due."
SECTION 2. Article 1, Chapter 11, Title 9 of the 1976 Code is amended by adding:
"Section 9-11-360. Notwithstanding any other provisions of this chapter, an employer other than the State may elect not to make the employer contribution required for an employee to establish nonmember service. Once made, this election is irrrevocable and applies for all employees. An employee of an electing employer may nevertheless establish nonmember service in the manner provided in this chapter by paying both the employee and employer share of the payment due."
SECTION 3. This act takes effect upon approval by the Governor.
