The House assembled at 9:30 A.M.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Our gracious God, we thank You for Your bounty that has sustained us, for Your discipline which has corrected us, and for Your love which has forgiven us. Amid the shifting shadows of the temporal, take from us the dimness of our sight that we may see with clear vision to discern the shining truths of the eternal. Cause us to look beyond our selfish ambitions and hollow pride and behold Your unchangeable truths standing like mountain peaks piercing the skies.

Keep us loyal and steadfast to the moral laws of Mt. Sinai and to the everlasting truths of the Sermon on the Mount. Amen.

POINT OF ORDER

Rep. ROBINSON raised the Point of Order that Amendment No. 133 was out of order under Rule 5.4 which states that no Bill or amendment providing an appropriation to pay a private claim against this State or a department thereof shall be introduced or considered.

Rep. BAXLEY argued contra the Point in stating that it was not a private relief and there were numerous individuals involved and the money went directly to the probate relief fund which was a statewide fund.

The SPEAKER stated that there was precedence where money was appropriated for the Arthur Smith Tournament and Lutheran Family Services and they were ruled out of order under Rule 5.4. He further stated that clearly under Rule 5.4 and Article X of the Constitution the General Assembly could not make direct appropriations to a private entity.

Rep. BAXLEY stated that it was not a private entity but a statewide public fund.

Rep. ROBINSON stated that it still paid a private claim and the Rule didn't allow that.

Rep. BAXLEY continued to argue that it was not a private claim and it involved numerous individuals over a period of years and it was administered by the Supreme Court and the Treasurer's Office.

The SPEAKER stated that it was not in order under Rule 5.4 and he sustained the Point of Order and ruled the Amendment out of order.

RECORD FOR JOURNAL

As an employee of USC, I did not vote on Amendment 63 of Section 18.

Rep. MARGARET J. GAMBLE

STATEMENT FOR JOURNAL

I voted against this amendment because it would place the budget out of balance. I will only consider an amendment that replenishes the funds it expends.

Rep. J. GARY SIMRILL

RECORD FOR JOURNAL

When the roll call vote was taken to table Amendment #63 to H. 3362, I was out of the Chamber meeting with Mr. John B. Reeves of the Dept. of Natural Resources RE: The Federal funding of the US fish hatchery in Oconee County. If I had voted I would have voted to table the amendment for the reason that the source of funding was not provided.

Rep. BRADLEY D. CAIN

RECORD FOR JOURNAL

I voted to table amendment #63 to H. 3362 because I was very concerned that there was no source of funding given for the proposed amendment. I fully support higher education; however, I cannot blindly vote to give any proposal additional funding without knowing where the corresponding reduction occurs. I believe that the amendment would have eroded our ability to fully fund property tax relief. The people of South Carolina and District 2 deserve to have property tax relief in the greatest amount possible, and I fully support this tax relief.
