Whereas, James Hugh McFaddin, the son of Hugh McFaddin and Elizabeth J. Aiken, was born on September 6, 1912, at Fullwood Plantation in Clarendon County; and
Whereas, Judge McFaddin settled as an attorney and farmer in Manning and was associated with the law firm of Davis and McFaddin; and
Whereas, Judge McFaddin served in the Eighty-second, Eighty-third, and Eighty-fourth General Assemblies from 1937-1942; and
Whereas, Judge McFaddin resigned from the Senate in 1942 to serve in the United States Army throughout World War II, rising in rank from first lieutenant to major; and
Whereas, after the war Judge McFaddin again was elected to the Senate and served until 1958 when he was elected judge of the third judicial circuit; and
Whereas, serving on the bench until 1970, Judge McFaddin expressed a strong interest in improving the penal system and revising the legal statutes; and
Whereas, offices and memberships he held include delegate to the national Democratic Convention in 1948 and 1956, Clarendon County attorney, delegate for Clarendon County to the state Democratic Convention in 1958, member of the American Bar Association, American College of Trial Judges, American Bar Judicature Society, Masons, Shriners, Knights of Pythias, Elks and Rotary clubs, American Legion, and Veterans of Foreign Wars. Now, therefore,
Be it resolved by the Senate, the House of Representatives concurring:
That the General Assembly of the State of South Carolina, by this resolution, requests the Department of Transportation to name U.S. Highway 527 from the Sumter County line to the Williamsburg County line in Clarendon County the James Hugh McFaddin Highway and to place appropriate markers or signs on the highway reflecting the designation.
Be it further resolved that a copy of this resolution be forwarded to the family of Judge James Hugh McFaddin.

Amend the bill, as and if amended, by striking SECTION 5 and inserting therein the following:
/"SECTION 5. Article 1, Chapter 54, Title 12 of the 1976 Code is amended by adding:
"Section 12-54-300. Sections 12-54-300 through 12-54-350 are known and may be cited as the 'Driver's Privacy Protection Act'.
Section 12-54-310. As used in Sections 12-54-300 through 12-54-350:
(1) 'Department' means either the Department of Revenue or the Department of Public Safety;
(2) 'Motor vehicle record' means any record that pertains to a motor vehicle operator's permit, motor vehicle title, motor vehicle registration, or identification card issued by the department;
(3) 'Person' means an individual, organization, or entity, but does not include the State or a department or agency thereof; and
(4) 'Personal information' means information that identifies an individual, including an individual's photograph; social security number; driver identification number; name; mailing address or street address, but not does not include the county of registration or the five-digit zip code; telephone number; and medical or disability information. 'Personal information' does not include information on vehicular accidents, driving violations, and driver status.
Section 12-54-320. (A) Except as provided in subsection (B), the department, or any officer, employee, or agent thereof, shall not knowingly disclose or otherwise make available to any person personal information about any individual obtained by the department in connection with a motor vehicle record.
(B) The personal information referred to in subsection (A) shall be disclosed for use in connection with matters of motor vehicle or driver safety and theft, motor vehicle emissions, motor vehicle product alterations, recalls, or advisories, performance monitoring of motor vehicles and dealers by motor vehicle manufacturers, and removal of non-owner records from the original owner records of motor vehicle manufacturers to carry out the purposes of the Automobile Information Disclosure Act, the Motor Vehicle Information and Cost Saving Act, the National Traffic and Motor Vehicle Safety Act of 1966, the Anti-Car Theft Act of 1992, and the Clean Air Act, and may be disclosed as follows:
(1) for use by any governmental department or agency, including any law enforcement agency, in carrying out its functions;
(2) for use in connection with any civil, criminal, administrative, or arbitral proceeding in any federal or state court or agency, including the service of process, investigation in anticipation of litigation, and the execution or enforcement of judgments and orders, or pursuant to an order of a federal or state court;
(3) for use by any insurer or insurance support organization, or by a self-insured entity, or its officers, employees, or agents, in connection with claims investigation activities, anti-fraud activities, rating, or underwriting;
(4) for use in providing notice to the owners of towed or impounded vehicles;
(5) for use by any registered private investigative agency or security service for any purpose permitted under this subsection;
(6) for use by an employer or its agent or insurer to obtain or verify information relating to a holder of a commercial driver's license that is required under the Commercial Motor Vehicle Safety Act of 1986 (49 U.S.C. App. 2710 et seq.);
(7) for any other use in response to requests for motor vehicle records if the motor vehicle department has provided in a clear and conspicuous manner on forms for issuance or renewal of driver's licenses or permits, titles, registrations, and identification cards, notice that personal information collected by the department may be disclosed to any business or person, and has provided in a clear and conspicuous manner on these forms an opportunity to prohibit such disclosures;
(8) for bulk distribution for surveys, marketing, or solicitations if the motor vehicle department has implemented methods and procedures to ensure that:
(a) individuals are provided an opportunity, in a clear and conspicuous manner, to prohibit such uses; and
(b) the information will be used, rented, or sold solely for bulk distribution for surveys, marketing, and solicitations;
(9) for use by any requester if the requester demonstrates it has obtained the written consent of the individual to whom the information pertains; or
(10) for any other use specifically authorized under any other provision of law, if such use is related to the operation of a motor vehicle or public safety.
Section 12-54-330. The department must maintain a permanent record of each request made, which must include the name of the person making the request and the date and purpose of the request. The department shall maintain this record for two years from the date of the request.
Section 12-54-340. (A) It is unlawful for any person knowingly and wilfully to obtain or disclose personal information from a motor vehicle record for any use not permitted under Sections 12-54-300 through 12-54-350.
(B) It is unlawful for any person knowingly and wilfully to make false representation to obtain any personal information from another person's motor vehicle record.
(C) It is unlawful for a person authorized to receive personal information under Sections 12-54-300 through 12-54-350 to knowingly and wilfully sell or disclose the information to another person.
(D) A person who violates the provisions of Sections 12-54-300 through 12-54-350 is guilty of a misdemeanor and, upon conviction, must be fined five thousand dollars or imprisoned not more than one year, or both. Each violation of this act constitutes a separate offense.
Section 12-54-350. (A) In addition to the criminal penalties provided in Section 12-54-340, a person who knowingly obtains, discloses, or uses personal information from a motor vehicle record for a use or purpose not permitted under this act shall be civilly liable to the individual to whom the information pertains.
(B) In an action brought pursuant to this section, the court may award: (1) actual damages, but not less than $2,500; (2) punitive damages upon proof of willful or reckless disregard of the law; (3) reasonable attorney's fees and other litigation costs reasonably incurred; and (4) such other equitable relief as the court determines to be appropriate."
SECTION 6. The unnumbered item added to Section 30-4-40(a) of the 1976 Code by Act 1 of 1995, bearing Ratification Number 513 of 1994, is repealed.
SECTION 7. Sections 1 through 4 of this act take effect upon approval by the Governor. Sections 5 and 6 of this act take effect January 1, 1996./

To accomplish the purposes of this chapter, counties are empowered to impose one of the following sources of revenue: a sales and use tax as provided in item (A), a toll authorized by the county governing body to be used and imposed by an authority established pursuant to Section 4-37-10 in accordance with the provisions of item (B), or the sales and use tax provided in item (A) and the toll provided in item (B), in accordance with the provisions of item (C)./
Amend the bill further, as and if amended, page 11, after line 36, by adding the following:
/(C)(1) Notwithstanding any other provision of law, a county governing body may combine the ordinances provided in items (A) and (B) into a single ordinance for a single project and the county election commission shall place the questions on the ballot provided in items (C)(2) and (C)(3).
(2) The question which must be included in a referendum held pursuant to item (C)(1) must read substantially as follows:
'I approve a special one percent sales and use tax and a toll to be imposed in (county) for not more than (time) to fund the following project or projects:

The additional question must read substantially as follows:

Amend the bill, as and if amended, page 3, line 29, by inserting after /imposed/ /only/ and by striking /but not both/; line 33, by inserting after /(B)/ /or a local option gasoline tax as provided in item (F)/.
Amend further, page 13, by inserting immediately after line 14:
/"(F)(1) Subject to the requirements of this item, the governing body of a county may impose by ordinance a tax on retail sales of gasoline within its jurisdiction for a specific purpose and for a specific period of time to collect a limited amount of money.
(2) The governing body of a county or municipality may vote to impose the tax authorized by this item, subject to a referendum, by enacting an ordinance. The ordinance must specify:
(a) the purpose for which the proceeds of the tax is to be used, which may include projects located within or without, or both within and without, the boundaries of the county or municipality imposing the tax and which may include those purposes provided in item (A)(1)(a) of this section:
(b) the maximum time, stated in calendar years or calendar quarters, or a combination thereof, not to exceed seven years, for which the tax may be imposed; and
(c) the maximum cost of the project or facilities funded from proceeds of the tax and the maximum amount of net proceeds to be raised by the tax.
(3) Upon receipt of the ordinance, the county election commission shall conduct a referendum on the question of imposing the optional gasoline tax in the jurisdiction. The referendum must be held on the Tuesday following the first Monday in November of an even numbered year. The commission shall cause the date and purpose of the referendum to be published once a week for four consecutive weeks immediately preceding the date of the referendum, in a newspaper of general circulation in the jurisdiction.
(4) A separate question must be included on the referendum ballot for each purpose and the question must read substantially as follows:
'Must a ____ cent(s) a gallon gasoline tax be imposed in (county) for not more than (time) to raise the amounts specified for the following purposes:
(1) $_______________ for

(2) etc.'
(5) All qualified electors desiring to vote in favor of imposing the tax for a particular purpose shall vote 'yes' and all qualified electors opposed to levying the tax for a particular purpose shall vote 'no'. If a majority of the votes cast are in favor of imposing the tax for one or more of the specified purposes, then the tax is imposed as provided in this item; otherwise the tax is not imposed. A subsequent referendum on this question must not be held more than once in twelve months and any referendum must be held on the date specified in item (3). The election commission shall conduct the referendum under the election laws of this State, mutatis mutandis, and shall certify the result no later than December thirty-first to the appropriate governing body and to the Department of Revenue and Taxation. Included in the certification must be the total of the project costs receiving a favorable vote. Expenses of the referendum must be paid by the jurisdiction conducting the referendum.
(6) If the tax is approved in the referendum, the tax is imposed on May first following the date of the referendum. If the certification is not timely made to the Department of Revenue and Taxation, the imposition is postponed for twelve months.
(a) The tax terminates on the earlier of:
(i) the final day of the maximum time specified for the imposition; or
(II) the end of the calendar month during which the Department of Revenue and Taxation determines that the tax has raised revenues sufficient to provide the county net proceeds equal to or greater than the amount specified as the amount to be raised by the tax.
(b) When the local gasoline tax is imposed for more than one purpose, the governing body of the jurisdiction authorizing the referendum for the tax shall determine the priority for the expenditure of the net proceeds of the tax for the purposes stated in the referendum.
(c) Amounts collected in excess of the required proceeds must first be applied, if necessary, to complete a project for which the tax was imposed; otherwise, the excess amounts must be credited to the general fund of the jurisdiction imposing the tax.
(7) The tax levied pursuant to this item must be administered and collected by the Department of Revenue and Taxation in the same manner that the sales and use tax is administered and collected. The sales tax return shall contain a line reporting gallons of gasoline sold for the purpose of calculating the tax. Every establishment selling gasoline at retail in a jurisdiction imposing the tax shall obtain a retail sales license.
(8) The revenues of the tax collected in each county under this item must be remitted to the State Treasurer and credited to a fund separate and distinct from the general fund of the State. After deducting the amount of refunds made and costs to the Department of Revenue and Taxation of administering the tax, not to exceed one percent of the revenues, the State Treasurer shall distribute the revenues quarterly to the county in which the tax is imposed and these revenues must be used only for the purpose stated in the imposition ordinance. The State Treasurer may correct misallocation costs or refunds by adjusting subsequent distributions, but these adjustments must be made in the same fiscal year as the misallocation.
(9) The Department of Revenue and Taxation shall furnish data to the State Treasurer and to the counties receiving revenues for the purpose of calculating distributions and estimating revenues. Information about a specific taxpayer is considered confidential and is governed by the provisions of Section 12-54-240. A person violating this item is subject to the penalties provided in Section 12-54-240.
(10) The Department of Revenue and Taxation may promulgate regulations necessary to implement this item."/

When procuring the construction, maintenance, and repair of bridges, highways, and roads, an authority must use the same procurement methods and apply the same procurement requirements used by and applied to the South Carolina Department of Transportation in the construction, maintenance, and repair of bridges, highways, and roads including the provisions of Section 12-27-1320 except that when applying Section 12-27-1320, the contracting entity may meet the expenditures standards of Section 12-27-1320 by either direct or indirect contracts. For purposes of this provision, "contracting entity" includes a governmental body and a private entity with which a governmental body contracts for the construction, maintenance, and repair of bridges, highways, and roads./
