4 PROGRAMS OF PALMETTO UNIFIED SCHOOL DISTRICT 1 OF THE SOUTH CAROLINA DEPARTMENT OF
5 CORRECTIONS, SO AS TO REVISE SUCH FUNDING AND THE MANNER IT IS DETERMINED AND DISTRIBUTED.

8 A. Section 24-25-35 of the 1976 Code, as added by Act 497 of 1994, is amended to read:

10 "Section 24-25-35. The Palmetto Unified School District 1 of the South Carolina Department of Corrections shall submit appropriate
11 student membership information to the State Department of Education and the South Carolina Department of Education's appropriation
12 request under the line item "Education Finance Act" shall include sufficient funds for the Palmetto Unified School District 1. The amount
13 to be requested for the Palmetto Unified School District 1 shall be sufficient to produce funds equal to the product of the number of
14 students served by the school district weighted according to the criteria established by the South Carolina Department of Education under
15 the provisions of the South Carolina Education Act of 1977 and the state portion of the appropriated value statewide of the base student
16 costs, adjusted for twelve months operation. The Palmetto Unified School District No. 1 shall comply with the following provisions of
17 subsection (4) of Section 59-20-50, subsections (1), (2), (3)(a), (4)(b), (c), (d), (e), and (f) of Section 59-20-60. The South Carolina
18 Department of Education annually shall determine that these provisions are being met and include its findings in the report mandated in
19 subsection (5)(e) of Section 59-20-60. If the accreditation standards set forth in the Defined Minimum Program for the Palmetto Unified
20 School District No. 1 as approved by the State Board of Education are not met, funds by this section shall be reduced the following fiscal
21 year according to the provisions set forth in the Education Finance Act. The Palmetto Unified School District 1 of the South Carolina
22 Department of Corrections shall not be eligible for funding under the Education Finance Act of 1977. Adult education funding shall be
23 distributed to the Palmetto Unified School District 1 by the South Carolina Department of Education in the same manner and formula as
24 for public school districts for those students who are in a K-12 program of the Palmetto Unified School District. Students under the age
25 of sixteen who are incarcerated at the Department of Corrections and in the Palmetto Unified School District are eligible for adult education
26 funding, notwithstanding any other provisions of law to the contrary. Nothing in this section requires the Department of Corrections to
27 lower the number of full-time equivalent positions. In the event the director decides that the number of full-time equivalent positions must
28 be reduced, administrative staff positions shall be considered first for this reduction and any reduction must come from outside of Palmetto
29 Unified School District 1. Further, the Department of Corrections must not decrease the salaries for teachers in the Palmetto Unified
30 School District 1."

32 B. This section takes effect July 1, 1998.
