27 SECTION 42 - R04 - PUBLIC SERVICE COMMISSION

29 42.1. (PSC: Assessment Certification) The Public Service Commission shall certify to the Department of Revenue and Taxation the
30 amounts to be assessed to cover appropriations in this section as follows: (1) the amount applicable to the assessment on public utility,
31 telephone utility, radio common carrier and electric utility companies as provided for by Section 58-3-100, Code of Laws of 1976, (2) the
32 amount to be assessed against gas utility companies as provided for in Section 58-5-940, Code of Laws of 1976, (3) the amount to be
33 assessed against electric light and power companies as provided for in Sections 58-3-100 and 58-27-50, Code of Laws of 1976, and (4)
34 the amount to be covered by revenue from motor transport fees as provided for by Section 58-23-630, and other fees as set forth in Section
35 58-3-100, Code of Laws of 1976. The amount to be assessed against railroad companies shall consist of all expenses related to the
36 operations of the Railway subprogram of the Agency's Transportation Division, to include the related distribution of salary increments
37 and employer contributions not reflected in the related subprogram of this Act as set forth in Section 58-3-100, Code of Laws of 1976.
38 42.2. (PSC: Indirect Cost) The assessment certification prepared for the Department of Revenue and Taxation shall include an
39 allocation of indirect cost as approved by the Budget and Control Board representing the Public Service Commission's proportionate share
40 of the cost of central State government.

1 42.3. (PSC: Transportation Fee Refund) The Motor Transport Division Transportation Department of the Public Service Commission
2 is hereby authorized to make refunds of fees which were erroneously collected.
3 42.4. (PSC: Certification Assessment for Commission Expenses) The Public Service Commission shall make such certification as
4 required under Section 58-3-100, Code of Laws of 1976.
5 42.5. (PSC: Attorneys Appointment) The three attorneys provided for in this section under Program I "Administration" shall be
6 appointed by the Commission with the approval of the Attorney General and be assigned to the Commission.
7 42.6. (PSC: Maximum Salary Limit) The salaries of the chairman and the commissioners as provided in this section shall not be
8 construed as limiting the maximum salary which may be paid to other employees of the Public Service Commission.
9 42.7. (PSC: Transfer Dual Party Relay Fund-State Government) Beginning July 1, 1998, from the funds in Subfund 4129 named Dual
10 Party Relay, the Commission shall transfer the following: $125,000 to the Department of Insurance to fund seven new other funded FTE
11 positions, $1,200,000 to the Department of Transportation for partial reimbursement of workers' compensation claims paid by the
12 Department of Transportation for Department of Public Safety employees and $ 875,000 shall be remitted to the General Fund only for
13 FY 98-99.
14 42.8. (PSC: Transfer Dual Party Relay Fund-Local Entities) Beginning July 1, 1998, from the funds in Subfund 4129 named Dual
15 Party Relay, the Commission shall transfer the following: $300,000 for the Community Recreation Special Purpose Tax District - Horry,
16 and $1,000,000 to the Lake Marion Regional Water Agency only for FY 98-99.
17
