6 47.1. (INS: Rate Division Auto Insurers Assessment) The costs of operating the Rate Division shall be borne by insurers of
7 automobile insurance. Not later than sixty days after the effective date of this Act, the Chief Insurance Commissioner shall assess each
8 automobile insurer for its just proportion of the amount appropriated by the General Assembly herein for the operation of the Rate
9 Division, such amount to also include appropriated salary adjustments and employer contributions allocable to the Rate Division. Such
10 assessments shall be in the proportion that each insurer's preceding calendar year direct written premium for automobile insurance in this
11 State bears to the total direct written premium for all insurers of automobile insurance in this State during such preceding calendar year.
12 For purposes of this section, direct written premium shall be as reflected in the latest annual statements of automobile insurers in this State
13 filed with the Commissioner. Funds appropriated by the General Assembly for the operation of the Rate Division shall be advanced by the
14 State until the assessments levied herein are collected and deposited in the General Fund of the State.
15 47.2. (INS: Examiners Travel/Subsistence Reimbursement) Notwithstanding the limitations in this Act as to amounts payable or
16 reimbursable for lodging, meals, and travel, the Department of Insurance is authorized to reimburse Department examiners in accordance
17 with guidelines established by the National Association of Insurance Commissioners only when the State is reimbursed by an insurance
18 company for the travel and subsistence expenses of Insurance Department examiners pursuant to S. C. Code Section 38-13-10, 1976.
19 47.3. (INS: Reimbursement Carry Forward) Reimbursements received for Data Processing Services, Revenue, Miscellaneous
20 Revenue and Sale of Listings and Labels shall be retained for use by the Department. These funds may be carried forward in the current
21 fiscal year to be expended for the same purposes.
