17 10.1. (DMH: Medicare Revenue) All Federal Funds received by the Department of Mental Health from patients' Medicare benefits
18 shall be considered as patient fees under the provision of Act No. 1276 of the 1970 Acts (provision for the issuance of bonds to be repaid
19 from patient fees) except that the Department shall remit to the General Fund of the State $290,963 from such funds to support the
20 appropriation for administrative costs of the collection of Medicare benefits. The Department shall retain and expend up to $3 million
21 of all Medicare Revenue earned prior to July 1, of the prior fiscal year, but received in the current fiscal year from cost recovery efforts,
22 all additional prior earnings shall be remitted to the General Fund, except that the cost and fees of identifying and collecting such additional
23 Medicare Revenue to which the Department is entitled may be paid from funds actually collected from such efforts.
24 10.2. (DMH: Paying Patient Account) Notwithstanding any other provision of law and in addition to other payments provided in
25 Part I of this Act, the Department of Mental Health is hereby directed during the current fiscal year to remit to the General Fund of the
26 State the amount of $3,800,000 to be paid from the surplus funds in the paying patient account which has been previously designated for
27 capital improvements and debt service under the provisions of Act 1276 of 1970. It is the intent of the General Assembly to assist the
28 Department to reduce and eventually eliminate this obligation to the General Fund.
29 10.3. (DMH: Patient Fee Account) Notwithstanding any other provisions of law and in addition to other payments provided in Part
30 I of this Act, the Department of Mental Health is hereby authorized during the current fiscal year, to provide the funds budgeted herein
31 for $6,214,911 for Departmental operations, $400,000 for the Continuum of Care, $10,000 for the Alliance for the Mentally Ill, $250,000
32 for S.C. SHARE Self Help Association Regarding Emotions, $50,000 for Palmetto Pathways, $50,000 for New Day Clubhouse and up
33 to $685,000 for day-to-day operations at the Campbell Nursing Home , from the Patient Fee Account which has been previously designated
34 for capital improvements and debt service under provisions of Act 1276 of 1970. The Department of Mental Health is authorized to fund
35 the cost of Medicare Part B premiums from its Patient Fee Account up to $150,000. The South Carolina Alliance for the Mentally Ill shall

1 provide an itemized budget before the receipt of funds and quarterly financial statements to the Department of Mental Health. The South
2 Carolina Self-Help Association Regarding Emotions shall provide an itemized budget before the receipt of funds and quarterly financial
3 statements to the Department of Mental Health. DMH is authorized to use unobligated Patient Paying Fee Account funds for community
4 transition programs. The funds made available shall be utilized consistently with the Transition Leadership Council's definition of severely
5 mentally ill children and adults. The Department shall report their use of these funds to the Senate Finance Committee and the House Ways
6 and Means Committee. This amendment is made notwithstanding other obligations currently set forth in this proviso.
7 10.4. (DMH: Paying Patient Fee Hall Institute) Notwithstanding any other provisions of law and in addition to other payments
8 provided in this section, the Department of Mental Health is authorized to utilize up to $1,530,520 of the funds collected from paying
9 patients hospitalized in the acute care units of the William S. Hall Psychiatric Institute to defray the cost of training mental health personnel
10 and psychiatric research at that facility pursuant to Section 44-11-10(2), Code of Laws of South Carolina, 1976; these being a part of the
11 funds previously designated for capital improvements and debt service under the provisions of Act 1276 of 1970.
12 10.5. (DMH: Institution Generated Funds) The Department of Mental Health is authorized to retain and expend institution generated
13 funds which are budgeted.
14 10.6. (DMH: Harris Psychiatric Hospital Carry Forward) The Budget and Control Board shall authorize the Department of Mental
15 Health to carry forward any remaining funds allocated for Harris Psychiatric Hospital in the prior fiscal year to assure full-funding of Harris
16 Psychiatric Hospital in the current fiscal year. The Department is authorized to utilize these funds to provide for community screening
17 and service for potential admission to Harris Psychiatric Hospital.
18 10.7. (DMH: VA Nursing Home Carry Forward) The Department is authorized to carry forward into the current year, funds
19 allocated in the prior fiscal year for the operation of the Campbell Nursing Home. Funds carried forward shall be expended for the same
20 purpose during the current fiscal year.
21 10.8. (DMH: Transfer of Patients to DDSN) DMH is authorized to transfer to the Department of Disabilities & Special Needs, state
22 appropriations to cover the state match related to expenditures initiated as a result of the transfer of appropriate patients from DMH to the
23 Department of Disabilities & Special Needs. Notwithstanding any other provisions of law and in addition to other payments as authorized
24 in this Act, DMH is also authorized to utilize up to $500,000 from the Patient Fee Account to help defray costs of these transferees.
25 10.9. (DMH: Harris Hospital Funds Transfer Notification) Prior to any transfer of funds from the current budget for Harris Hospital,
26 the Department shall notify the Chairmen of the Senate Finance Committee and the House Ways and Means Committee.
27 10.10. (DMH: Sale of Property Revenue) The Department may retain revenues associated with the sale of property titled to or utilized
28 by the Department and may expend these funds on capital improvements approved by the Joint Bond Review Committee and the Budget
29 and Control Board.
30 10.11. (DMH: Department Owned Housing Rental) The Department of Mental Health may charge other than fair market value for
31 rental of department-owned housing when such rentals assist in the recruitment and training of mental health professionals.
32 10.12. (DMH: Study of Hall Institute) The Department shall review its staffing practices at Hall Institute and provide a report to
33 the State Reorganization Commission, the House Ways and Means Committee and the Senate Finance Committee by December 1, 1998.
34 10. 13. (DMH: Practice Plan) Employees of the Department affiliated with the University of South Carolina School of Medicine, who
35 hold faculty appointments in the School, may participate in the School's Practice Plan provided that participation not take place during

1 regular working hours. Funds generated by such participants shall be handled in accordance with University policies governing Practice
2 Plan funds
3 10.14. (DMH: Utilization of the Byrnes Clinical Center) A mission appropriate and cost effective action plan for the continued
4 utilization of the Byrnes Clinical Center must be submitted by the Mental Health Commission to the State Reorganization Commission,
5 House Ways and Means Committee and Senate Finance Committee by July 1, 1998.
6 10.15. (DMH: Mentally Ill Alternative Care Feasibility Study) The Department is directed to study the feasibility of reducing the
7 state cost for caring for the mentally ill currently in institutional settings by arranging for care in alternative settings through a
8 private/public or public/public partnership. The study shall include input from advocacy organizations, consumer groups, industry
9 representatives and affected state agencies. The Department shall report to the Office of the Governor, the Senate Finance Committee
10 and the House Ways and Means Committee on the results of this study no later than February 15, 1999.
