7 SECTION 51 - R60 - EMPLOYMENT SECURITY COMMISSION

9 51.1. (ESC: Salary Level) The salaries of the Chairman, the Commissioners, and the Agency Director of the Employment Security
10 Commission shall be no less than that agreed to by the United States Department of Labor.
11 51.2. (ESC: Dept. of Revenue & Taxation Access to Report) The Employment Security Commission shall allow the Department of
12 Revenue and Taxation access to the Employer's Quarterly Report and any by-product of such report.
13 51.3. (ESC: SCOICC User Fee Carry Forward) All user fees collected by the S.C. Occupational Information Coordinating Committee
14 through the Employment Security Commission may be retained by the SCOICC to be used for the exclusive purpose of operating the S.C.
15 Occupational Information System. All user fees not expended in the prior fiscal year may be carried forward for use in the current fiscal
16 year.
17 51.4. (ESC: JTPA Prior Year Payments) The Employment Security Commission shall be allowed to pay Job Training Partnership
18 Act prior year obligations with current year funds.
19 51.5 (ESC: Unemployment Compensation Contribution Rates) (A) Notwithstanding any provision contained in Section 41-31-80 of
20 the 1976 Code, with respect to the computation of the statewide reserve ratio for employer contributions to the State Unemployment
21 Compensation Fund, for the period January 1, 1998 1999 through December 31, 1998 1999, the following contribution rates apply:
22 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals or exceeds 9%, then the
23 contribution rate is .54%;
24 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals 8% but is less than 9%, then the
25 contribution rate is .89%;
26 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals 7% but is less than 8%, then the
27 contribution rate is 1.24%;
28 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals 6% but is less than 7%, then the
29 contribution rate is 1.59%;
30 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals 5% but is less than 6%, then the
31 contribution rate is 1.94%;
32 If the resultant percentage of the employer's reserve balance divided by the annual payroll equals 4% but is less than 5%, then the
33 contribution rate is 2.29%;
34 If the resultant percentage of the employer's reserve balance divided by the annual payroll is less than 4%, then the contribution rate
35 is 2.64%.

1 (B) All other provisions of Chapters 27 through 42, Title 41, of the 1976 Code are applicable for the period January 1, 1998 1999
2 through December 31, 1998 1999.
3 51.6. (ESC: Consortium Contracts: Training-Development Sessions and Media Services) All earmarked funds collected for the LMI -
4 Training-Development Sessions; the ALMIS LMI Training Institute; Media Services and Program Contracts through the South Carolina
5 Employment Security Commission may be retained by the agency to be used for the exclusive purpose of operating these programs. All
6 funds not expended in the prior fiscal year may be carried forward for use in the current fiscal year.
7 51.7. (ESC: Welfare-to-Work Earmarked Funds) All earmarked funds collected by SCESC in order to operate and match the Welfare-
8 to-Work Grant Funds may be retained by the agency to be used for the exclusive purpose of operating this program. All funds not
9 expended in the prior fiscal year may be carried forward for use in the current fiscal year.
