21 63E.1. (BCB/AUD: Access of Records) Notwithstanding any other provision of law, for the purposes of carrying out his duties, the
22 State Auditor and his assistants or designees shall have access to all records and facilities of every state agency during normal operating
23 hours. Furthermore, the State Auditor and his assistants or designees shall have access to all relevant records and facilities of any private
24 organization which is appropriated state monies, relating to the management and expenditures of such funds, during the organization's
25 normal operating hours. In the performance of his official duties, the State Auditor and his assistants or designees are subject to the
26 statutory provisions and penalties regarding the confidentiality of records of the respective agency, or organization, under review. All audit
27 working papers and memoranda of the State Auditor, with the exception of final audit reports, are confidential and not subject to public
28 disclosure.
29 63E.2. (BCB/AUD: Audit Timeframes) Notwithstanding any other provision of law, the State Auditor may examine less often than
30 annually agencies, departments, commissions and divisions provided that every such agency, department, commission or division shall
31 be examined no less often than every third year.
32 63E.3. (BCB/AUD: Contracts for State Audits) In the event qualified personnel cannot be hired during the current fiscal year, any
33 unused personal service funds in Subsection 63E, may be used to contract private firms to perform audits as prescribed by the State
34 Auditor.

1 63E.4. (BCB/AUD: Fraud Hot Line) The State Auditor is directed to maintain a Fraud Hot Line, and provide statewide toll free
2 telephone service for use by citizens of this State to report incidences of waste, fraud, misuse, and abuse of state funds. The State Auditor
3 is further directed to advertise the Fraud Hot Line in an appropriate manner.
4 63E.5. (BCB/AUD: Medical Assistance Audit) The Department of Health and Human Services shall remit to the General Fund an
5 amount representing fifty percent (allowable Federal Financial Participation) of the cost of the Medical Assistance Audit as established
6 in the State Auditor's Office of the Budget and Control Board Section 63E such amount to also include appropriated salary adjustments
7 and employer contributions allowable to this program. Such remittance to the General Fund shall be made monthly and based on invoices
8 as provided by the State Auditor's Office of the Budget and Control Board.
