TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-4-65 SO AS TO AUTHORIZE ISSUANCE OF AN EX PARTE ORDER FOR PROTECTION FROM DOMESTIC ABUSE UNDER CERTAIN CIRCUMSTANCES AND TO AUTHORIZE GRANTING OTHER RELIEF IN THE ORDER RELATIVE TO CUSTODY AND SUPPORT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 20-4-65. The court may issue an ex parte order of protection when a petition for relief is presented to the court and it appears that:
(1) the summons or petition cannot be served;
(2) the respondent is likely to leave the jurisdiction;
(3) the safety of the petitioner is endangered; or
(4) other circumstances exist which in the discretion of the court warrant issuance of the order.
The ex parte order also may include relief for temporary custody, temporary child support, temporary alimony, possession of the marital home, and other relief as may be appropriate."
SECTION 2. This act takes effect upon approval by the Governor.
