TO AMEND SECTION 20-7-127, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO IMMUNITY FROM LIABILITY FOR GUARDIANS AD LITEM, SO AS TO EXPAND THIS IMMUNITY TO INCLUDE ALL ACTS PERFORMED BY A GUARDIAN WITHIN THE SCOPE OF THE APPOINTMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 20-7-127 of the 1976 Code, as amended by Act 450 of 1996, is further amended to read:
"Section 20-7-127. After participating in the training program of the Guardian ad Litem Program, a person who is appointed to serve as guardian ad litem and serves without compensation is not liable for any civil damages for any personal injury as a result of any act or omission by the person in the discharge of the responsibilities of a guardian ad litem if the acts of the person acts in good faith and is not guilty of gross negligence are performed within the scope of the appointment as guardian ad litem."
SECTION 2. This act takes effect upon approval by the Governor.
