TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-790 SO AS TO REQUIRE THE DEPARTMENT OF TRANSPORTATION TO SUBMIT TO THE HOUSE EDUCATION AND PUBLIC WORKS COMMITTEE AND THE SENATE TRANSPORTATION COMMITTEE A REPORT ENUMERATING ALL CONSTRUCTION AND MAINTENANCE PROJECTS UNDER CONSTRUCTION OR PROPOSED FOR THE CURRENT OR SUBSEQUENT FISCAL YEAR AND TO PROHIBIT THE DEPARTMENT FROM EXPENDING FUNDS IN THE UPCOMING FISCAL YEAR ON THESE PROJECTS UNTIL THE REPORT IS APPROVED IN ITS ENTIRETY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 57-3-790. (A) Annually before December first the Department of Transportation shall submit to the House Education and Public Works Committee and the Senate Transportation Committee a report of all construction and maintenance projects under construction or proposed for the current or subsequent fiscal year. The report also must include:
(1) maps indicating the geographic location of each project;
(2) estimated cost of each project with major costs itemized including, but not limited to, engineering and design;
(3) the anticipated allocation of state and federal funds, or other sources, to be used to pay for each project;
(4) the criteria used in project selection;
(5) the current status of each project, including the percentage of the project completed, whether and to what extent the project is on schedule, and the anticipated completion date;
(6) the department engineer primarily responsible for the project.
(B) Before the department may expend funds in the fiscal year following submission of the report for the construction and maintenance projects enumerated in the report, the General Assembly must approve the report in its entirety by joint resolution introduced by the House Education and Public Works Committee or the Senate Transportation Committee. No projects or portions of the report may be approved while other projects or portions are disapproved."
SECTION 2. This act takes effect July 1, 1997.
