TO AMEND SECTION 56-1-2070, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROHIBITION AGAINST DRIVING A COMMERCIAL MOTOR VEHICLE WITHOUT A VALID LICENSE AND CERTAIN EXCEPTIONS TO THIS PROHIBITION, SO AS TO PROVIDE FOR ADDITIONAL EXEMPTIONS BASED ON FEDERAL EXEMPTIONS THAT ALLOW THE TRANSPORTATION OF CERTAIN HAZARDOUS WASTE MATERIALS WHICH POSE NO SUBSTANTIAL THREAT TO PUBLIC HEALTH AND SAFETY WHEN USED IN NORMAL FARMING OPERATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-1-2070(B)(2)(b) of the 1976 Code is amended to read:
"(b) used to transport agricultural products, farm machinery, farm supplies, or a combination of them to or from a farm including the transportation of hazardous materials which pose no substantial danger to public health and safety including fuels, fertilizers, and other agricultural chemicals used in normal farming operations exempted pursuant to 49 C.F.R Part 173.5;"
SECTION 2. This act takes effect upon approval by the Governor.
