TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 10 TO CHAPTER 11 OF TITLE 8, SO AS TO PROVIDE THAT IF A STATE EMPLOYEE IN THE SCOPE OF HIS EMPLOYMENT GENERATES FUNDING IN EXCESS OF THE OPERATIONAL EXPENSES OF THE AGENCY FOR WHICH HE WORKS OR FUNDS THAT WOULD CONSTITUTE A PROFIT FOR THE AGENCY FOR WHICH HE WORKS, THEN THAT EXCESS FUNDING OR PROFIT MUST BE DEPOSITED IN THE STATE'S GENERAL FUND FOR USE BY THE AGENCY FOR WHICH HE WORKS AND MUST NOT BE PAID TO A NON-PROFIT CORPORATION AFFILIATED WITH THE AGENCY FOR WHICH HE WORKS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 11 of Title 8 of the 1976 Code is amended by adding:
"Section 8-11-810. If a state employee in the scope of his employment generates:
(1) funding in excess of the operational expenses of the agency for which he works, or
(2) funds that would constitute a profit for the agency for which he works,
that excess funding or profit must be deposited in the state's general fund for use by the agency for which the state employee works and must not be paid to a non-profit corporation affiliated with the agency for which he works."
SECTION 2. This act takes effect upon approval by the Governor.
