TO AMEND SECTION 59-19-70, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DUTIES OF THE CHAIRMAN AND CLERK OF A SCHOOL BOARD OF TRUSTEES, SO AS TO PROVIDE THAT THE APPROVED MINUTES OF EACH MEETING OF THE BOARD BE POSTED ON THE DISTRICT'S INTERNET WEBSITE, IF THE DISTRICT MAINTAINS A SITE, AND TO PROVIDE TIME FRAMES FOR THIS POSTING, TO PROVIDE THAT NOTICE OF MEETINGS OF THE SCHOOL BOARD BE PUBLISHED IN A LOCAL NEWSPAPER OF GENERAL CIRCULATION AND POSTED ON THE DISTRICT'S INTERNET WEBSITE, IF THE DISTRICT MAINTAINS A SITE, TO PROVIDE THAT NOTICE INCLUDES DATE, TIME, PLACE, AND AGENDA OF THE MEETING, AND TO PROVIDE THAT THE BOARD'S ANNUAL REPORT TO THE CITIZENS OF THE DISTRICT INCLUDES A LIST OF THE MEETINGS HELD IN THE PREVIOUS YEAR, AND THE AGENDA AND APPROVED MINUTES OF EACH MEETING.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-19-70 of the 1976 Code is amended to read:
"Section 59-19-70. (A)(1) The trustees shall, as soon as practicable after the appointment of any new trustee, organize by the election of one of their members as chairman and another as clerk of the board. The chairman shall preside at meetings of the board and perform other duties imposed on him under the law, and the clerk shall keep a record of the proceedings of all meetings in a book provided for that purpose and perform all other duties required of him by law.
(2) If the school board or district maintains an internet website, the minutes of the meeting must be posted to the site within five days after they are adopted and remain on the site for the next thirty days.
(B)(1) In addition to the requirements of the Freedom of Information Act as provided in Section 30-4-80, notice of the date, time, place, and agenda of each regularly scheduled meeting of the board must be published in a local newspaper of general circulation at least twenty-four hours before the meeting. If practicable, notice for any called, special, or rescheduled meeting must be published. The notice must include the date, time, place and agenda of the meeting. This requirement does not apply to an emergency meeting of the board.
(2) If the school board or district maintains an internet website, it must give notice on the site of the dates, times, and places of its regular meetings at the beginning of each calendar year. The agenda, if any, for a regularly scheduled meeting must be posted on the site at least twenty-four hours before the meeting. The notice for any called, special, or rescheduled meeting must be posted on the site as early as practicable, but not later than twenty-four hours before the meeting. The notice must include the date, time, place, and agenda of the meeting. This requirement does not apply to an emergency meeting of the board.
(C) In an annual report to the citizens of the district, the board must include a list of the meetings held in the previous year and the agenda and approved minutes of each meeting."
SECTION 2. This act takes effect upon approval by the Governor.
