Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 34-11-140. (A) A person may be required to present a credit card for identification when he draws, makes, utters, issues, or delivers to another a check, a draft, or other written order on a bank or depository for the payment of money or its equivalent, whether given to obtain money, services, credit, property, or anything of value, but the cashing entity or person shall not copy the credit card account number.
(B) Subsection (A) does not prohibit a person from recording a credit card number and expiration date as a condition for cashing a check where that person has agreed with the card issuer to cash checks as a service to the issuer's cardholders and the issuer guarantees cardholder checks cashed by that person.
(C) A person who violates the provisions of this section is guilty of a misdemeanor and upon conviction must be fined not more than two hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
