TO AMEND SECTION 59-63-230, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NOTICES TO PARENTS OF A STUDENT'S SUSPENSION AND CONFERENCES WITH THE PARENT OR GUARDIAN AS A RESULT OF THE SUSPENSION SO AS TO REQUIRE CONFERENCES BEFORE A STUDENT WHO HAS BEEN SUSPENDED SHALL BE ALLOWED TO RE-ENTER SCHOOL AND TO PERMIT A SCHOOL BOARD TO REQUIRE THE SHADOWING OF A STUDENT BY HIS PARENTS OR GUARDIAN AS A CONDITION OF RE-ADMISSION IF THE STUDENT HAS BEEN SUSPENDED AT LEAST TWICE BEFORE DURING THAT SCHOOL YEAR.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-63-230 of the 1976 Code is amended to read:
"Section 59-63-230. When a pupil is suspended from a class or a school, the administrator shall notify, in writing, the parents or legal guardian of the pupil, giving the reason for such suspension and setting a time and place when the administrator shall be available for a conference with the parents or guardian. The conference shall be set within three days of the date of the suspension. Pupils shall not be allowed to re-enter school until such conference has been held. After the conference the parents or legal guardian may appeal the suspension to the board of trustees or to its authorized agent. If a pupil has been suspended twice in a school year, the local board of trustees may require as part of the pupil's re-admission if the pupil is suspended again that the pupil's parents or guardian shadow them for a minimum of two hours per day for a period of up to three days. Should the board of trustees make shadowing a condition of re-admission, the board shall determine the number of days and periods of time for this to take place with consideration given to the work schedules and other obligations of the parents or guardian.
SECTION 2. This act takes effect upon approval by the Governor.
