TO EXPRESS THE INTENT OF THE GENERAL ASSEMBLY WITH RESPECT TO THE TRANSFER OF CERTAIN FUNDS APPROPRIATED TO THE OFFICE OF APPELLATE DEFENSE TO THE OFFICE OF INDIGENT DEFENSE FOR DEPOSIT INTO THE DEATH PENALTY TRIAL FUND.
Be it resolved by the House of Representatives, the Senate concurring:
That the following items express the intent of the General Assembly with respect to the transfer of certain funds appropriated to the Office of Appellate Defense pursuant to Section 2 (21), Part III, Act 419 of 1998.
(1) On or about June 30, 1999, if the Office of Appellate Defense determines, after taking into consideration all outstanding obligations against the fund appropriated pursuant to Section 2 (21), Part III, Act 419 of 1998 for payment of attorney fees and expenses in capital post conviction relief cases, that unexpended funds remain, these funds must be transferred to the Office of Indigent Defense for deposit into the Death Penalty Trial Fund for payment of attorney fees and expenses in capital cases; and
(2) Upon receipt of these funds, the Office of Indigent Defense first shall pay any outstanding obligations remaining in the Death Penalty Trial Fund. However, once all obligations in the Death Penalty Trial Fund have been satisfied, the Office of Indigent Defense shall then transfer any remaining funds into the Conflict Fund for payment of attorney fees and expenses in noncapital cases and pay any outstanding obligations remaining to the extent possible.
Be it further resolved that a copy of this resolution be forwarded to the Honorable James Lander, Comptroller General.
